PRODUCTION NOTICE. 9.1 The Operator shall call a Management Committee meeting to consider the Feasibility Report for a date no sooner than three months and no later than six months after the Feasibility Report was provided to each of the parties. 9.2 The Management Committee shall consider the Feasibility Report prepared and may approve the Feasibility Report, with such modifications, if any, as it considers necessary or desirable, together with an estimate of Construction Costs. If a Feasibility Report is approved as aforesaid the Management Committee shall forthwith cause a Production Notice to be given to each of the parties by the Operator stating that the Management Committee has approved that a Mine be established and brought into production in conformity with the Feasibility Report and estimated Construction Costs as so approved.

PRODUCTION NOTICE. 10.1 The Operator shall call a meeting of the Management Committee to consider the Feasibility Report for a date no sooner than six months after the Feasibility Report was provided to each of the Parties. 10.2 The Management Committee shall consider each Feasibility Report prepared and may approve any Feasibility Report with such modifications, if any, as it considers necessary or desirable. Such approval by the Management Committee must be given by Participants holding aggregate Interests of not less than 75%. If the Feasibility Report is a Non-Operator's Feasibility Report the Operator is not entitled to vote with respect to the approval thereof. If a Feasibility Report is approved as aforesaid the Management Committee shall forthwith cause a Production Notice to be given to each of the Parties with an Interest by the Operator stating that the Management Committee intends to establish and bring a Mine into production pursuant to the Feasibility Report as so approved.
PRODUCTION NOTICE. 5.8.3. MFR may, in writing, direct CM to stop the production of Products during any stage of the manufacturing process (a “Stop Production Notice”). MFR has the right to direct CM to prepare Products up through a particular level of the manufacturing process and to hold such partially completed Products pending resolutions to be implemented as a result of error correction activities. If such a Stop Production Notice from MFR is not due to CM’ s negligence or failure to perform its obligations under this Agreement, MFR shall be responsible for the actual and reasonable costs of downtime and idle capacity charges incurred by CM resulting from a Stop Production Notice and for the actual and reasonable costs associated with the holding of partially completed Products and any required rework of Product.

PRODUCTION NOTICE. Unless otherwise agreed, after expiration of a six (6) month waiting period from the date a completed Feasibility Study is approved or deemed approved by the Management Committee under Sections 13.1(c) or 13.1(d), either Participant can approve moving forward with construction of a Mine. Upon making such a determination, such approving Participant shall forthwith cause a notice (a “Production Notice”) to be given to the other Participant by the Operator stating that a Mine has been approved to be built and brought into commercial production in conformity with the Feasibility Study and estimated Development Expenditures. Subject to Section 13.2, each Participant may contribute its share of Development Expenditures in proportion to its Participating Interest. If a Participant elects not contribute its pro rata share of the Development Expenditures, the Participating Interest of any contributing Participant shall be increased and that of any non-contributing Participant shall be decreased in accordance with the dilution provisions in this Agreement.
PRODUCTION NOTICE. 10.1 PRODUCTION RECOMMENDATION Within 60 days of the production of the Feasibility Report, the Operator shall call a Management Committee meeting to consider the Feasibility Report. The Management Committee shall consider such Feasibility Report prepared and may, subject to the resolution of any outstanding issues contemplated in Section 10 herein, approve the Feasibility Report, with such modifications, if any, as it considers necessary or desirable. Forthwith after approval of the Feasibility Report, the Management Committee shall cause the Operator to give notice (in this Agreement called the "PRODUCTION RECOMMENDATION") to each of the Participants stating that the Management Committee recommends that a Mining be established and brought into production in conformity with the Feasibility Report as so approved.
