(f) The study shall be taken under normal working conditions using stock and material which the operator can normally expect to receive.
(g) A standard shall not be considered to be established until the worker(s) to whom it applies and the Union have been notified as to the standard and at least thirty (30) days with provisions for an extension, if necessary, have passed following such notification.
(h) If no grievance is filed by the worker(s) on the job, within five (5) working days after the specified period, the standard shall be considered established, and the Union is precluded from the National Uniongrieving that standard thereafter. The Company will notify the Union and employees regarding the date that the standard is considered to be established.
(i) When a dispute arises over the standard during the specified period, the worker shall make information available discuss his complaint with his supervisor. If the matter is not resolved, the worker and a Union representative may request a meeting with a representative from the Industrial Engineering Department and review the work sheets in order to him and resolve the problem. If the matter is unsettled, a grievance may be filed, signed by the worker(s), within five (5) days of the meeting, at Step #2 of the Grievance Procedure.
(j) Should the dispute continue the Union shall have the right to request that their representative meet with a restudy if Company Industrial engineer to review all of the job appears improperly studied. If a Union Time Study Expert is utilized under this section, material that was prepared to develop the cost of such service shall be borne by the Union. Refer to Article 9.06 of this Appendix for specific procedures on grievances over production standardsStandard.
9:02 (k) Any such dispute that goes to arbitration shall have an arbitrator whom the parties mutually agree, has recognized Industrial Engineering experience.

9:02 19.01 The Company will establish all production standards according to the procedure set forth and may use any accepted Industrial Engineering technique in Section 9:03 of this Articledoing so. The Company will make available may establish, revise, discontinue, reinstitute and/or maintain incentive standards on the jobs, which it concludes lend themselves to the application of such standards. The production standards used under the incentive system shall be established so as to encourage incentive effort. Incentive standards shall not be reduced or increased unless there has been a change or changes in methods or conditions which directly affect the value of the job by a measurable amount three percent (3%) or more, either individually or cumulatively). Standards shall be revised upon the discovery of a mathematical or clerical error, which has been made in the calculation of the standard. Such error, if discovered by the Company, shall immediately be communicated to the Union. Changes in standards will be reviewed with the Union upon at least five (5) working days before implementation of any change to provide the Union the opportunity to review the reason(s) for the change(s), and review the documentation relating to the change(s).
19.02 The Standards Program will be expressed in terms of standard hours which will be paid for at the applicable base rates as contained in Appendix A of this Agreement. Appropriate allowances shall be made for rest periods, necessary personal time and minor unavoidable delays. It is understood that payment will be made only for acceptable pieces or material produced to the specified quality level except where lack of quality is in no way attributable to the fault of the operator.
19.03 Incentive earnings will be computed for each employee (or group where applicable) for the total hours worked on incentive during a payroll week, and the employee’s applicable base rate will be guaranteed for the week provided that the employee’s failure to earn at least the applicable base rate is in no way attributable to the fault of the operator.
19.04 After a new or revised incentive standard is established on a job, employees shall be expected to make a reasonable effort to develop incentive earnings on the job for not less than thirty (30) days. No formal grievance shall be filed or processed concerning a new or revised incentive standard during this period although employees and the Union may advise the Company within this period that they feel the standard is incorrect and request complete data showing a recheck. After completion of the basis upon above thirty (30) day trial period, the grievance may be filed in the grievance procedure within fifteen (15) days. Any such grievance will not be processed beyond acceptance in Step 1 until the job in question has been run on at least three (3) occasions. Any change which a particular is made in the incentive standard pursuant to the grievance and arbitration procedure shall be retroactive to the date that this standard was determined. 19.05 The Company shall establish, when established, revise and discontinue temporary incentive standards and allowances on operations where the Company feels that a permanent standard is not appropriate and the employee’s applicable base rate will be given a fair trial period. (e) In the event a controversy exists in reference to the standard as established in the foregoing paragraphs, a grievance shall be written, whereupon the Company agrees to restudy the job within forty eight (48) hours of the filing of the grievance, providing the job is in production at the time or within twenty four (24) hours after the job is again in production. The time limits as outlined above may be extended by mutual agreement.
9:02 The Company will establish production standards according to the procedure set forth in Section 9:03 of this Article. The Company will make available to the Union upon request complete data showing the basis upon which a particular standard was determined. Production standards, when established, will be given a fair trial period. A minimum fair trial period will be two(2(2) two days or two (2) normal production runs of less than eight (8) hours and a maximum of five (5) days or twofive (5) normal production runs of less than eight (8) hours.
(a) When a standard is to be established on a job, the Company shall specify the tooling, methods, layout, speeds and feed and production techniques to be used.
(b) Before an operation is studied, the methods analyst shall establish in conjunction with the operator and the xxxxxxx if necessary, the method of operation for the operation being studied.
(c) Before an operation is studied, the operator will be notified that a study is to be taken.
(d) No probationary employee shall be studied for the purpose of setting a standard.
9:03 The following procedure shall be used to establish standards:
(a) The methods analyst shall record the following, on Univel observation sheets:
i) The breakdown of elements of the operation in their sequence of performance, a description of the elements outlining the methods and motion pattern to be followed in the performance of the operation.
ii) A description of the tooling, methods, layout, speeds and feeds, and production techniques to be used.
iii) A description or identification number of the equipment upon which the operation is performed, and date of study.
iv) The amount and frequency of inspection, if any, to be performed by the operator.
v) A detailed sketch of the working area, including the location of stock, and the location of the finished work container.
(b) To determine the production standard, the analyst shall use the following procedure:
i) The work as it is being performed by the operator will be filmed until the analyst feels he has covered the process. The analyst will make all reasonable efforts to avoid facial shots.
ii) The analyst then uses the film to breakdown the method used to manufacture the part and records all aspects of the method on a Univel coding sheet found within the full methods report.
iii) The analyst will then use the standard Univel procedure to develop the allowance for the particular study.
iv) The Univel system will generate the standard time from the coding sheets and allowances found within the full methods report.
(c) After the study has been completed:
i) The industrial engineering department will furnish to the production department involved operation description sheets which will contain a complete description of the job as covered by the study, and from this point on the job will be run in accordance with this information.
ii) The Univel observation sheet, and all supporting data and supplementary documents used to record information pertaining to the job shall be kept in a permanent file by the industrial engineering department. Films will not be kept in the permanent files and will be disposed of at an appropriate time following the implementation of the study and in no event no later than thirty (30) days.
iii) At the conclusion of the study, the employee who has been studied shall be advised of the production standard.
9:04 On being assigned to a job for which a production standard has been placed in effect, the employee shall be advised by his xxxxxxx as to what such standard is. Continued failure or refusal of an employee to produce on the basis of such production standards shall be considered due cause to discipline, unless the failure is due to causes beyond his control, or a grievance is in process on such production standard. When the Company contemplates disciplinary action for failure to perform in accordance with production standards, the Union Xxxxxxx shall be notified promptly that the employee has been given the first warning and the reason for such warning.

PRODUCTION STANDARDS. 9:01 It is A. Production incentive standards shall be established by the Employer. They will be established by means of accepted Industrial Engineering technique, including standard data. The Union will have the right to examine sources of standard data. Wherever any change affects only part of a job, the Employer may restudy only the affected elements unless such change would affect the preceding elements and succeeding elements. He shall also understand that each job will stand on its own merit.
E. It is agreed that any standard will be set on considered correct if the basis average operator working at a job he can do well can earn at least twenty-five percent (25%) above standard while working at incentive pace. The Employer recognizes that incentive Associates producing at effort in excess of normal working conditions, (over one hundred and twenty-five percent (125%) as defined above) will generate additional earnings over time rates. An Associate producing at an effort less than normal for his classification of work shall be given notice to bring his production standard up to at least normal within thirty (30) days. Failure to do so may subject such Associate to transfer to another job classification or assignment to any job vacancy in the quality of workmanship and the normal working capabilities of normal, experienced operators, who is someone who holds the job postingplant.

The designated time study xxxxxxx will receive appropriate in-house training on the time study system and time study training. Any additional training will be by mutual agreement. The companies cost for training will be limited to time off with pay for a maximum of three (3) weeks, on a one time basis every three (3) years. If the time study xxxxxxx becomes part of management, then this section will be used for the training of a new time study xxxxxxx. All provisions of articles and will apply to the time study xxxxxxx except that this individual will not be a member of the bargaining committee.
