Productivity and Contracting. The parties recognize the Employer's obligation to the public to maintain and preserve the physical facilities of the District and to provide ancillary educational services at a reasonable cost. Accordingly, nothing in this Agreement shall limit the right of the Employer to use such equipment, techniques, and procedures or to contract or subcontract work as the Employer may determine to be in the best interest of the public, provided, however, that this provision shall not be used for the purpose of undermining the Union or discriminating against any of its members.
