PROHIBITION OF GRATUITIES a. Seller represents and warrants it and its officers, employees, agents and representatives have not offered or given, and agrees it and its officers, employees, agents and representatives will not offer or give, any kickbacks or gratuities in the form of entertainment, gifts, or otherwise to any officer or employee of Buyer or Buyer’s customer with a view toward securing this or any other Purchase Order, any favorable treatment with respect to the awarding or amending of this or any other Purchase Order, or the making of any determination with respect to Seller’s right or duties. b. For any breach of Seller’s obligations under this Clause, Buyer shall have, in addition to any other rights provided by this AGREEMENT, the right to terminate any or all AGREEMENTS with Seller for cause, and to recover from Seller the amount of any gratuity, plus all reasonable costs (including attorney fees) incurred in seeking such recovery.

PROHIBITION OF GRATUITIES. Buyer may terminate this Agreement for default in the event Buyer determines that Seller or any of its officers, directors, employees or agents offered or gave a gratuity or thing of value to any officer, employee or agent of Buyer. The rights and remedies of Buyer under this Article 31 shall not be exclusive and/or in addition to any rights and remedies provided by law or under this Agreement.

(Seller is also advised that, if this Contract is issued under a prime contract or subcontract of the U.S. Government, any gratuity covered by this Clause may also entail further liabilities of Seller under applicable statutes or other provisions.)
PROHIBITION OF GRATUITIES. ‌ To certify that no elected official or employee of the State of Florida has or shall benefit financially or materially from this Agreement in violation of the provisions of Chapter 112, F.S. This Agreement may be terminated if it is determined that gratuities of any kind were either offered or received by any of the aforementioned parties.

PROHIBITION OF GRATUITIES. All of the parties hereby certify that the provisions of O.C.G.A. § 45-10-20 through § 45 10-28, which prohibit and regulate certain transactions between State Officials, employees and the State of Georgia, and O.C.G.A. § 45-1-6, which prohibits gratuities, have not been violated and will not be violated in any respect throughout the term of this Contract.

The provisions of this section shall not apply to political contributions unless such contributions are conditioned upon the performance of specific actions of the person accepting such contribution nor shall they prohibit a parent, grandparent or relative from making a gift to a child, grandchild, or other close relative for love and affection except as hereinafter provided."
PROHIBITION OF GRATUITIES. Neither CONTRACTOR nor any person, firm or corporation employed by CONTRACTOR in the performance of the Agreement shall offer or give any gift, money or anything of value or any promise for future reward or compensation to any WSU employee at any time.
