Common use of Project Design Clause in Contracts

Project Design. Seller shall determine the location, design, configuration, and capacity of each Facility as it deems appropriate, subject only to the Requirements, including the characteristics and other requirements for such Facility set forth in Appendix B, and also subject to any conditions which are imposed by any Governmental Authority as part of the environmental review of each New Facility required under applicable Federal and Nevada law.

Project Design. Seller shall determine the proposed location, design, configuration, configuration and capacity capacities of each the Facility as it deems appropriate, subject only to the Requirementsrequirements of this Agreement and all applicable Requirements of Law, including but not limited to the characteristics and other requirements for such the Facility set forth in Appendix B, and also subject to any conditions which are imposed by any Governmental Authority responsible agency (including, but not limited to Buyer) as part of the any applicable environmental or siting review of each New the Facility required under applicable Federal and Nevada lawwhich Seller deems acceptable.
