Common use of Project, Resources and Scheduling Clause in Contracts

Project, Resources and Scheduling.  Project activities will begin, as mutually agreed to, after the Agreement has been fully executed.  The City of Elizabeth City, NC has the ability allocate additional internal resources if needed.  Xxx Xxxx xx Xxxxxxxxx Xxxx, XX also ensures the alignment of their budget and Scope expectations.  The City of Elizabeth City, NC and Tyler ensure that the assigned resources are available, they buy‐into the change process, and they possess the required business knowledge to complete their assigned tasks successfully. Should there be a change in resources, the replacement resource should have a comparable level of availability, buy‐in, and knowledge.  Abbreviated timelines and overlapped Phases can result in project delays if there are not sufficient resources assigned to complete all required work as scheduled.  Changes to Project Plan, availability of resources or changes in Scope may result in schedule delays, which may result in additional charges to the Project.  Tyler provides a written agenda and notice of any prerequisites to the City of Elizabeth City, NC Project Manager(s) ten (10) business days prior to any scheduled on site or remote sessions.  Tyler provides notice of any prerequisites to the City of Elizabeth City, NC Project Manager(s) a minimum of ten (10) business days prior to any key deliverable due dates.  City of Elizabeth City, NC users complete prerequisites prior to applicable scheduled activities.  Tyler provides guidance for configuration and processing options available within the Tyler software. The City of Elizabeth City, NC is responsible for making decisions based on the options available.  In the event the City of Elizabeth City, NC may elect to add and/or modify current business policies during the course of this Project, such policy changes are solely the City of Xxxxxxxxx City, NC’s responsibility to define, document, and implement.  The City of Elizabeth City, NC makes timely Project related decisions in order to achieve scheduled due dates on tasks and prepare for subsequent training sessions. Decisions left unmade may affect the schedule, as each analysis and implementation session builds on the decisions made in prior sessions.  Tyler considers additional services out of Scope and requires additional time and costs be requested via Change Request approved through the Change Control process.  The City of Elizabeth City, NC will respond to information requests in a comprehensive and timely manner, in accordance with the Project Plan.

If notice is not provided within ten (10) business days, the City may require the workshop or associated activity to be rescheduled without incurring penalty or expense.  Tyler provides notice of any prerequisites to the City of Elizabeth City, NC Project Manager(sif Bend’s project manager(s) a minimum of ten (10) business days prior to any key deliverable due dates.  The City of Elizabeth City, NC Bend’s users complete prerequisites prior to applicable scheduled activities. If notice is not provided within ten (10) business days, the City may require the workshop or associated activity to be rescheduled without incurring penalty or expense.  Tyler provides guidance for configuration and processing options available within the Tyler software. The City of Elizabeth City, NC Bend is responsible for making decisions based on the options available.  In the event the City of Elizabeth City, NC Bend may elect to add and/or modify current business policies during the course of this Project, such policy changes are solely the City of Xxxxxxxxx City, NCBend’s responsibility to define, document, and implement. Tyler will assist the City with appropriate accommodation of the policy within the solution.  The City of Elizabeth City, NC Bend makes timely Project related decisions in order to achieve scheduled due dates on tasks and prepare for subsequent training sessions. Decisions left unmade may affect the schedule, as each analysis and implementation session builds on the decisions made in prior sessions.  Tyler considers additional services out of Scope and requires additional time and costs be requested via Change Request approved through the Change Control process.  The City of Elizabeth City, NC Bend and Tyler will respond to information requests in a comprehensive and timely manner, in accordance with the Project Plan.  The City may obtain at their own cost, the services of a 3rd party consultant to provide project review, advice and consultation. Tyler will cooperate with the efforts of this consultant within the context of the City’s participation, Deliverable review and approval timeframes identified within this contract.  Tyler deliverables and artifacts will be provided in a format agreed upon in advance by both parties.
