PROMOTIONAL ACTIVITY. Press releases and other like publicity, advertising or promotional material which mention the other party by name, this Agreement or any term hereof shall be agreed upon by both parties in writing prior to any release.

Notwithstanding the immediately prior sentence, however, no permission will be required by Customer pursuant to its disclosing under appropriately protective confidentiality agreements to potential and actual customers, financiers, acquirers or joint venture partners that IBM is manufacturing Products for Customer.
PROMOTIONAL ACTIVITY. 9.1 Distributor shall at all times retain a dedicated, competent and professional marketing staff which shall be responsible for educating the marketplace, maintaining contacts with customers and positioning and promoting the Products in the market. All such activities shall be at Distributor’s cost and expense, and Distributor shall not be entitled to request any reimbursement thereof from B. Furthermore, Distributor shall follow B’s direction on marketing activities, including without limitation, sending those Distributor sales and marketing personnel that B designates to certain Spring and Fall medical meetings. Distributor shall provide for B’s review and approval annual marketing plans for each upcoming sales year by no later than November 30 of each immediately preceding year. Distributor shall provide B at monthly meetings to be held between Distributor and B monthly status updates on product listings, account plans, marketing activities (including without limitation local congresses, advertisements, presentations, etc.) and market / competitor information, all based on pre-determined formats.
9.2 B shall have the right to pre-approve any promotional materials for the Products created by Distributor. B shall not be under any obligation to provide promotional materials or marketing samples of the Products to Distributor.
9.3 In the event of any malfunction of the Products, Distributor shall immediately arrange for a temporary replacement of the Products before the restoration of the normal function of the Products or before a permanent replacement is available.
PROMOTIONAL ACTIVITY. The co-sponsors will not use the workshop involving EPA, nor its affiliation with EPA, primarily as a vehicle to sell or promote products or services. The co-sponsors will take reasonable steps to ensure that any incidental promotional activity does not imply that EPA endorses any products or services. EPA does not endorse any commercial product, service or enterprise. The co-sponsors will make reasonable efforts, subject to EPA review, to segregate any incidental promotional activity from the main activities of the event.
PROMOTIONAL ACTIVITY. During the Services Term, Heartport will promote that its HRTC training courses utilize Vista Systems and will endorse such Vista Systems as the preferred three-dimensional video visualization and information solution for minimally invasive cardiac surgery and Vista will promote that Heartport's HRTC training course utilize Vista Systems. Such promotional activity will be subject to the written approval of at least one (1) member of the senior management of each of Heartport and Vista prior to its distribution. Heartport will provide Vista with lists of the names and hospital affiliations of the HRTC trainee surgeons on at least a quarterly basis. Heartport also agrees to endorse such Vista Systems as a preferred three-dimensional video visualization and information solution for minimally invasive cardiac surgery after the Services Term for so long as Vista is obligated to sell Vista Systems to Port-Access Hospitals pursuant to Article 6 hereof.
PROMOTIONAL ACTIVITY. The Advertiser undertakes to ensure that the Promotional Activity booked by The Advertiser under the terms of this Agreement, relates solely to the promotion of products and services provided by The Advertiser or, where The Advertiser is an agent, provided by The Advertiser’s Client.
PROMOTIONAL ACTIVITY. 9.1 Unless otherwise expressed by Client, ClarkeModet is hereby authorized to disclose its participation in the services and the name of Client for commercial, reputational, academic, or legal doctrine purposes.
9.2 ClarkeModet may include in its communications any information that is not confidential and deems appropriate regarding the services provided. Likewise, it may share such information with other companies in the ClarkeModet Group to provide a better service.

PROMOTIONAL ACTIVITY. Licensee agrees not to conduct any promotional activity with respect to any event to be conducted at the Arena without the prior written consent of the Licensor.
PROMOTIONAL ACTIVITY. 5.1 In promoting sales of the Products, the Broker must exclusively use the advertising material, samples and documentation provided by the Company and shall always state its position as an independent authorized broker, not as a representative nor agent of the Company. The activity of the Broker will be limited to the introduction of the potential client to the Company. In case the Parties agree to involve the Broker in the negotiations related to a possible transaction, such activity of the Broker, unless differently agreed in writing between the Parties, will be remunerated only with the Commission.
PROMOTIONAL ACTIVITY. Renter agrees not to publicly conduct any promotional activity and not to advertise any Event to be conducted at the Events Center without the prior written consent of the City. If promotion and/or advertising of the Event is permitted by the City, all advertising and promotion of the Event shall be the responsibility of Renter, at its sole cost. Renter shall be permitted to advertise and/or promote season registration with fourteen days written notice to the City.
