Common use of Proof of Membership Clause in Contracts

Proof of Membership. 30 31 Upon approval of the Sector’s operations plan for the 2019 and 2020 fishing years, each 32 sector vessel will be issued a Letter of Authorization (LOA) by the Regional 33 Administrator specifying the exemptions granted. Vessels must comply with all 34 applicable Federal regulations and laws not specifically exempted in the LOA. The LOA 35 with a copy of the approved Operations Plan for 2019 and 2020 must be carried on board 36 the vessel at all times in the Sector Manual. The LOA shall serve as Proof of Sector 37 Membership and shall be made available to any NMFS or enforcement officials upon 38 request. 40 Section 2.5 Member Obligations Apply Only to Participating Vessels 42 The obligations of the Members set forth in this Agreement shall only apply to the 43 Permits and Participating Vessels (and not to any other permits or vessels owned by the 44 Members that are not enrolled in this Sector pursuant to the terms hereof) to the extent 45 that such Permits or Participating Vessels are fishing commercially with gear that is 1 capable of harvesting multispecies species managed under the Northeast Multispecies 2 Fishery Management Plan. 4 Each Member agrees to ensure that all operators and crew of its Participating Vessels 5 fully comply with the obligations set forth in this Agreement. Each Member further 6 agrees to accept full responsibility for the actions of any such operators that result in a 7 violation of this Agreement.
