Common use of PROOF OF TITLE Clause in Contracts

PROOF OF TITLE. Developer shall furnish a title opinion, title report, title insurance commitment, title insurance policy, or marked up and signed pro forma title insurance policy, demonstrating that Developer is the fee owner of the Property prior to entering the same to construct the Improvements as provided herein. Developer agrees that in the event Developer's ownership in the Property should change in any fashion prior to the completion of the Improvements and the fulfillment of the requirements of this Agreement, Developer shall forthwith notify the City of such change in ownership. Developer further agrees that all dedicated streets and utility easements provided to the City shall be free and clear of all monetary liens (i.e., mortgage).
