PROPIEDAD OCUPADA. COMPRADOR ENTIENDE Y RECONOCE QUE EL VENDEDOR PUEDE XXXXX ADQUIRIDO LA PROPIEDAD (COMO SE DEFINE EN EL CONTRATO DE COMPRA) A TRAVÉS DE EJECUCIÓN HIPOTECARIA, ESCRITURA DE CESIÓN EN LUGAR DE EJECUCIÓN HIPOTECARIA, O PROCESO SIMILAR, QUE EL VENDEDOR NUNCA HA OCUPADO LA PROPIEDAD, Y QUE EL VENDEDOR TIENE POCO O NINGÚN CONOCIMIENTO DIRECTO SOBRE LA CONDICIÓN EN LA QUE SE ENCUENTRA LA PROPIEDAD. EL VENDEDOR NO HACE NINGUNA DECLARACIÓN O GARANTÍA EN CUANTO A SI LA PROPIEDAD ESTÁ OCUPADA AL CIERRE DE LA CUENTA EN PLICA PERO ENTIENDE QUE LA PROPIEDAD ESTÁ OCUPADA. LA PROPIEDAD PUEDE ESTAR SUJETA A DERECHOS DE ARRENDAMIENTO DE VARIOS ARRENDATARIOS. El Vendedor no tiene SAMPLE ninguna obligación de proporcionar información alguna al Comprador relativa a los arrendamientos, enmiendas o ningún otro documento, incluyendo pero sin limitarse a información relativa a cualquier procedimiento en curso de desahucio. El Comprador entiende y reconoce que el Vendedor no proporcionará ningún número de caso, el estatus actual de los procedimientos de desahucio, ni la información de contacto para el abogado del Vendedor. Además, el progreso y/o el resultado de cualquier caso de desahucio en curso no tendrá incidencia alguna en la transacción contemplada por el Contrato de Compra y sus términos, así como sus apéndices, incluyendo la Fecha de Cierre acordada por ambas Partes. El Comprador reconoce, además, que el Comprador será el único responsable de notificarle a cualquier inquilino u ocupante de la transferencia de la titularidad de la Propiedad, y es responsable para con cualquiera y todos los inquilinos para el repago de cualquier depósito de seguridad pendiente, salvo las deducciones legales. Esta disposición sobrevivirá el Cierre de la Cuenta en Plica y/o el Cierre de la transacción contemplada por el Contrato de Compra y este Apéndice, no se considerarán fusionados a cualquiera de los documentos ejecutados o entregados en el Cierre. Debido a que la Propiedad fue adquirida por el Vendedor a través de la ejecución hipotecaria, venta por un Síndico en virtud de un poder de venta de fiduciario, el poder de la venta bajo una hipoteca, venta o escritura en lugar de ejecución hipotecaria por un Alguacil, el Vendedor no tiene depósitos de seguridad o último mes de alquiler que entregarle al Comprador.

  • Data Storage Where required by applicable law, Student Data shall be stored within the United States. Upon request of the LEA, Provider will provide a list of the locations where Student Data is stored.

  • Training a. The employer, in consultation with the local, shall be responsible for developing and implementing an ongoing harassment and sexual harassment awareness program for all employees. Where a program currently exists and meets the criteria listed in this agreement, such a program shall be deemed to satisfy the provisions of this article. This awareness program shall initially be for all employees and shall be scheduled at least once annually for all new employees to attend.

  • Marketing Vendor agrees to allow TIPS to use their name and logo within the TIPS website, database, marketing materials, and advertisements unless Vendor negotiates this term to include a specific acceptable-use directive. Any use of TIPS’ name and logo or any form of publicity, inclusive of press release, regarding this Agreement by Vendor must have prior approval from TIPS which will not be unreasonably withheld. Request may be made by email to xxxx@xxxx-xxx.xxx. For marketing efforts directed to TIPS Members, Vendor must request and execute a separate Joint Marketing Disclaimer, at xxxxxxxxx@xxxx-xxx.xxx, before TIPS can release contact information for TIPS Member entities for the purpose of marketing your TIPS contract(s). Vendor must adhere to strict Marketing Requirements once a disclaimer is executed. The Joint Marketing Disclaimer is a supplemental agreement specific to joint marketing efforts and has no effect on the terms of the TIPS Vendor Agreement. Vendor agrees that any images, photos, writing, audio, clip art, music, or any other intellectual property (“Property”) or Vendor Data utilized, provided, or approved by Vendor during the course of the joint marketing efforts are either the exclusive property of Vendor, or Vendor has all necessary rights, license, and permissions to utilize said Property in the joint marketing efforts. Vendor agrees that they shall indemnify and hold harmless TIPS and its employees, officers, agents, representatives, contractors, assignees, designees, and TIPS Members from any and all claims, damages, and judgments involving infringement of patent, copyright, trade secrets, trade or services marks, and any other intellectual or intangible property rights and/or claims arising from the Vendor’s (including Vendor’s officers’, employees’, agents’, Authorized Resellers’, subcontractors’, licensees’, or invitees’) unauthorized use or distribution of Vendor Data and Property.

  • HEALTH AND SAFETY 16.01 The Employer, Union and the employees shall comply with the provisions of the Occupational Health and Safety Act where and when applicable. The Employer shall provide working conditions at all times which are not prejudicial to the health or efficiency of the workers. Employees are required to report to their Employer any unsafe work conditions, or violation of any safe work policies or procedures established by the Employer, or any violation of relevant safe work legislation.

  • Subscribing LEA An LEA that was not party to the original Service Agreement and who accepts the Provider’s General Offer of Privacy Terms.

  • Vacation During the Employment Period, the Executive shall be entitled to paid vacation in accordance with the most favorable plans, policies, programs and practices of the Company and its affiliated companies as in effect for the Executive at any time during the 120-day period immediately preceding the Effective Date or, if more favorable to the Executive, as in effect generally at any time thereafter with respect to other peer executives of the Company and its affiliated companies.

  • Safety Where an employee is prevented from working at the employee’s particular function as a result of unsafe conditions caused by the inclement weather, the employee may be transferred to other work in the employee’s classification on site, until the unsafe conditions are rectified. Where such alternative is not available and until the unsafe conditions are rectified, the employee shall remain on site. The employee shall be paid for such time without reduction of the employees’ inclement weather entitlement.

  • Reasonable Precautions XXX shall take reasonable precautions to secure usernames, passwords, and any other means of gaining access to the services and hosted Student Data.

  • Advertising Limitations Provider is prohibited from using, disclosing, or selling Student Data to (a) inform, influence, or enable Targeted Advertising; or (b) develop a profile of a student, family member/guardian or group, for any purpose other than providing the Service to LEA. This section does not prohibit Provider from using Student Data (i) for adaptive learning or customized student learning (including generating personalized learning recommendations); or (ii) to make product recommendations to teachers or LEA employees; or (iii) to notify account holders about new education product updates, features, or services or from otherwise using Student Data as permitted in this DPA and its accompanying exhibits

  • VACATIONS 13.01 All employees who are regularly scheduled seventy-five (75) hours on a bi- weekly basis shall receive vacations with pay based on length of full-time continuous service as follows:
