Proposal Request. 7.3.1.1 The Contracting Authority shall prepare and issue a Proposal Request to the DB to obtain the DB’s Proposal for the adjustment of the Contract Sum or Contract Times, or both, associated with a contemplated Modification. .1 In any Proposal for an adjustment of the Contract Sum, the DB shall specifically identify the items set forth in Section 7.7. .2 In any Proposal for an adjustment of the Contract Times, the DB shall specifically identify the items set forth in Section 7.8. .3 The DB’s cost of preparing and providing Proposals is included in the Contract Sum. 7.3.1.2 The DB shall respond with a Proposal to the Contracting Authority within 14 days after receiving the Proposal Request. The acceptance period may be adjusted by mutual consent of the DB and Contracting Authority. The time limits described under this Section 7.3.1.3 apply only to Proposals submitted in response to a Proposal Request. 7.3.1.4 A Proposal may be accepted by the Contracting Authority only through a Change Order. A Proposal Request does not authorize the DB to proceed with a change in the Work. 7.3.1.5 If the DB does not timely submit a Proposal within the time required in Section 7.3.1.2, the DB waives its right to an adjustment to the Contract Sum or Contract Times, or both, associated with the contemplated change in the Work. 7.3.1.6 If the Project is administered using the State’s web-based project management software, the DB shall respond to a Proposal Request issued by the Contracting Authority with its Proposal using the “Change Order” or “Contract Modifications” business process.
