Protected Employee. An employee who has a seniority date as a Brakeman prior to October 19, 1997 shall be designated as a “Protected Employee”. Protected Employees who have a seniority date prior to October 30, 1981 will not be laid off as a result of the implementation of three (3) man crews. In the event of a layoff on the system due to slackness of work a Protected Employee would be laid off only if he would have been subject to layoff in the same circumstances when reduced crews consisted of four men. Protected Employees who have a seniority date prior to October 19, 1997 will not be laid off as a result of implementing two (2) man crews. In the event of a layoff on the system due to a loss of business, a Protected Employee would only be laid off as a result of this loss, not due to the implementation of two-man crews.
