Protection of Persons, Work and Property. A. The risk of loss or damage to the Work prior to full completion of all Work hereunder and final acceptance thereof by Con Edison shall be borne by Contractor. B. In the course of performing the Contract, Contractor shall at all times exercise every reasonable precaution to protect persons and property and items of Work. Contractor shall at its own expense design, furnish, and erect such barricades, fences and railings, give such warnings, display such lights, signals and signs, exercise such precautions against fire, adopt and enforce such rules and regulations, and take such other precautions as may be necessary, desirable or proper, or as may be directed by Con Edison. Contractor shall provide and maintain in good working order at all times an adequate, approved system for promptly extinguishing fires. Fire alarms, extinguishing equipment and water lines shall be continually inspected by Contractor and shall at all times be accessible and ready for immediate use. C. Contractor shall, while on or about the site of Work, observe and comply with all fire, safety, hazard, "No Smoking", and all other rules and regulations heretofore or hereafter prescribed by Con Xxxxxx. Safety hats shall be worn at all times in the Work area by Contractor's employees. Whenever the Contractor or any permitted subcontractor performs Work hereunder, its employees and consultants are required to have available for review by Con Edison a Contractor (or a subcontractor) or government-issued name and photo identification. D. Contractor shall, at no additional cost to Con Edison, comply with all reasonable requests of Con Edison to enclose or specially protect Work, property or persons. If Con Edison determines that Work, property or persons are not adequately protected after any such requests, then it may, without prejudice to any other rights it may have hereunder or under applicable law, order an immediate suspension of the Work or take such steps as it deems necessary to protect Work, property or persons. The cost of such steps shall be charged to Contractor and may be deducted from any payments due Contractor, and Contractor shall not be entitled to be compensated for any costs of its own arising from such suspension. E. Contractor shall promptly report in writing to Con Edison all accidents whatsoever arising out of or in connection with the performance of the Contract, whether on or adjacent to the construction site, which result in death, injury or property damage, giving full details and statements of witnesses. In addition, if death or serious injury or serious damage is caused, Contractor shall immediately report the accident by telephone to Con Edison. F. Contractor shall provide at the construction site such equipment and medical facilities as are necessary to supply first aid service to any persons who may be injured in the course of performance of the Work and shall have standing arrangements for the removal and hospital treatment of such persons. If any claim is made by any person against Contractor or any other contractor on account of any accident, Contractor shall promptly report it in writing to Con Edison, giving full details of the claim. G. Contractor will not be permitted to perform any field work until it has submitted to Con Edison and received approval of a site-specific health, safety, and environmental plan, which shall address all hazards that may be encountered and shall conform to any and all requirements stated in the Contract. H. If in the reasonable opinion of Contractor greater precautions than those required herein or directed by Con Edison are advisable, Contractor shall implement such precautions and advise Con Edison thereof. In the event of an emergency threatening injury to persons or damage to property Contractor shall take all necessary action immediately and shall promptly notify Con Edison thereof.

E. Contractor D. Developer shall promptly report in writing to Con Edison CTO all accidents whatsoever arising out of or in connection with the performance of the ContractAgreement, whether on or adjacent to the construction site, which result in death, personal injury requiring medical treatment or absence from work or property damage, giving full details and statements of witnesses. In addition, if death or serious injury or serious damage is caused, Contractor Developer shall immediately report the accident by telephone to Con EdisonCTO. F. Contractor E. Developer shall, or shall cause the Subcontractors to, provide at the construction site such equipment and medical facilities as are necessary to supply first aid service to any persons who may be injured in the course of performance of the Work and shall have standing arrangements for the removal and hospital treatment of such persons. If any claim is made by any person against Contractor Developer or any other contractor on account of any accident, Contractor Developer shall promptly report it in writing to Con EdisonCTO, giving full details of the claim. G. Contractor F. Developer will, or will cause the Subcontractors to, develop a Health and Safety Plan for Work the Site that will be submitted to CTO for approval. Developer will not be permitted to perform any field work until it has submitted to Con Edison CTO and received approval of a site-specific health, safety, and environmental plan, which shall address all hazards that may be encountered and shall conform to any and all requirements stated in the ContractAgreement. The submitted plan for the transmission right-of-way shall provide a detailed Emergency Response Plan for each individual tower location and, for any tower locations within a Rattlesnake area, a list of which hospitals have the appropriate anti-venom. H. G. If in the reasonable opinion of Contractor Developer greater precautions than those required herein or directed by Con Edison CTO are reasonably advisable, Contractor Developer shall implement such precautions and advise Con Edison CTO thereof. In the event of an emergency threatening injury to persons or damage to property Contractor Developer shall take all necessary action immediately and shall promptly notify Con Edison CTO thereof.

H. E. If in the reasonable opinion of Contractor Licensee greater precautions than those required herein or directed by Con Edison Central Xxxxxx are advisable, Contractor Licensee shall implement such precautions and advise Con Edison thereofprecautions. In the event of an emergency threatening injury to persons or damage to property Contractor property, Licensee shall take all necessary action immediately and shall promptly notify Con Edison Central Xxxxxx thereof. F. Licensee is required to ensure that all vehicles, including those of contractors and suppliers, used in the performance of work are maintained in good working condition and are not leaking any fluids. Particular attention is to be paid, without limitation, to hydraulic systems on each vehicle. The driver must immediately notify a Central Xxxxxx authorized representative in the event of a leak or spill from a vehicle or container carried on a vehicle while at the job site. The driver must wait for instructions before moving the vehicle unless field conditions require it, and then, only to the nearest safe point. The driver will be required to eliminate the leak or spill before leaving the job site. Licensee shall be required to reimburse Central Xxxxxx for all costs associated with the cleanup of leaks and spills. G. Licensee shall, at its own expense, store its apparatus, material, supplies and equipment in such orderly fashion as will not interfere with the public, the progress of Licensee’s work or the work of others and clean up and remove all refuse, rubbish, scrap materials, and debris so that at all times the work site shall present a neat, orderly and workmanlike appearance. If, in the opinion of Central Xxxxxx, Licensee has failed to comply with any provisions of this Paragraph 4(G), Central Xxxxxx may order any or all of the work suspended until the conditions are corrected. Central Xxxxxx shall have no liability for any matter arising from or relating to any such work suspension. H. Should it reasonably appear to Central Xxxxxx, whether as a result of inspections and tests or otherwise, that any part of the work is not suitable or of good quality, or fails to conform to applicable requirements, Central Xxxxxx, without any liability to Licensee, shall have the option to: (i) stop the continuation of such work (without any liability for any matter arising from or relating to such work stoppage); and (ii) require Licensee to reconstruct, replace or correct the applicable work and remedy any damage to property of Central Xxxxxx and others occasioned by such work or the materials, methods or processes employed in connection therewith; or (iii) perform, or have performed by another, all work that is not suitable or of good quality or fails to conform to applicable requirements, at Licensee’s expense.

Protection of Persons, Work and Property. A. The risk 2.02.06.01 Design/Builder shall have overall responsibility for safety precautions and programs in the performance of loss or damage the Work. Design/Builder shall designate an individual at the Site in the employ of Design/Builder who shall act as Design/Builder’s designated safety representative with a duty to prevent accidents and to make daily inspections of the Work prior to full completion of all Work hereunder and final acceptance thereof Site. Unless otherwise identified by Con Edison Design/Builder in writing, the designated safety representative shall be borne by Contractor.be B. In 2.02.06.02 During the course of performing Work on the ContractProject, Contractor Design/Builder shall keep all required building exits free and unimpeded. Such exits shall not be closed at any time for any reason while the building is occupied or at any time when the building is unoccupied, except after written approval is given by Owner and proper warning and directional signs are posted. Barricades shall be erected so that traffic is separated and protected from the Work. 2.02.06.03 Design/Builder shall take all times exercise every reasonable precaution necessary precautions to ensure the safety of all of its employees, Subcontractors and other persons on the Project or who may be affected by the Work thereon. Design/Builder shall also take all necessary precautions to protect persons the Work and all materials and equipment incorporated therein or to be incorporated therein from damage or destruction, whether in storage on or off the Project Site and whether in the custody or control of Design/Builder or any of its Subcontractors. Design/Builder shall also take all necessary precautions to protect all property at the Project Site and items of Work. Contractor shall at its own expense designadjacent thereto not designated for removal, furnishrelocation or replacement, including trees, shrubs, lawns, walks, pavements, roadways, structures, and erect such barricades, fences and railings, give such warnings, display such lights, signals and signs, exercise such precautions against fire, adopt and enforce such rules and regulations, and take such other precautions as may be necessary, desirable or proper, or as may be directed by Con Edison. D. Contractor shall, at no additional cost to Con Edison, comply with all reasonable requests of Con Edison to enclose or specially protect Work, property or persons. Contractor shall promptly report in writing to Con Edison all accidents whatsoever arising out of or in connection with the performance of the Contract, whether on or adjacent to the construction site, which result in death, injury or property damage, giving full details and statements of witnesses. In addition, if death or serious injury or serious damage is caused, Contractor shall immediately report the accident by telephone to Con Edison. F. Contractor shall provide at the construction site such equipment and medical facilities as are necessary to supply first aid service to any employees and/or other persons who may be injured in affected by the course Work. Design/Builder shall erect and maintain all necessary safeguards to protect workers on the Project Site and the owners and users of performance of adjacent property, and shall post danger signs and other warnings against hazards created by the Work including but not limited to protruding nails, hoists, well holes, elevator shafts, hatchways, scaffolding, window openings, stairways, excavations, and falling materials. 2.02.06.05 Design/Builder shall be liable for all injury, damage or loss to any person or property caused in whole or in part by Design/Builder, any of its Subcontractors, or any person employed by or under the direction of Design/Builder or any of its Subcontractors. To the extent possible and unless otherwise directed by Owner, Design/Builder shall promptly repair, pay for or otherwise remedy any such injury, damage or loss and shall have standing arrangements for the removal indemnify and hospital treatment of such persons. If any claim is made by any person hold Owner harmless against Contractor or any other contractor on account of any accident, Contractor shall promptly report it in writing to Con Edison, giving full details of the claim. G. Contractor will not be permitted to perform any field work until it has submitted to Con Edison and received approval of a site-specific health, safety, and environmental plan, which shall address all hazards that may be encountered and shall conform to any and all requirements stated in the Contract.
