Common use of Protection of Property and Persons Clause in Contracts

Protection of Property and Persons. The Contractor shall protect its Work and all Materials and Equipment through Final Completion in accordance with standard industry methods so that the work or workers of other trades will not mar it during installation. The Contractor shall have full responsibility to install, protect and maintain all Materials and Equipment in proper condition and forthwith repair, replace and make good any damage thereto until Final Completion. The Contractor shall also temporarily protect any permanently installed work that may be damaged during the course of Contractor’s Work. The Contractor, and not the Owner’s Representative or the Owner, shall be responsible for any loss or damage that shall or may happen to the Work or any part or parts thereof or for any of the Materials and Equipment or other things used and employed in finishing and completing the Work, or for injury to any person or persons, whether workers or members of the public, or for damage to property resulting from the acts, omissions, fault or default of the Contractor in connection with its obligations hereunder. The Contractor shall properly remedy all damage or loss to any property caused in whole or in part by the Contractor, any of its Subcontractors or anyone directly or indirectly employed by any of them or anyone for whose acts any of them may be liable. The foregoing obligations are in addition to the Contractor’s indemnification obligations set forth elsewhere herein and in Article 8 of the Contract.
