Provider Liability. 4.10.1 The provider shall be responsible for any and all personal injury, including death, or property damage as a result of the provider’s actions, or inactions, including but not limited to, misconduct, negligence, or any future negligent act, involving any equipment or service provided under the terms and conditions, requirements and specifications of the agreement. a.
