Providing Service. (a) We will commence Service as soon as reasonably practicable after the Contract Date, and we may commence billing you as soon as the service is provisioned. (b) We may provide Service using Our Facilities and/or third party Partner Facilities, as we decide from time to time. Together, we call those Facilities our Network.

Providing Service. 1. No claim forms are used, but we must pre-authorize service by an independent service contractor. If a service contractor is not available in your area, we will ask that you call your preferred service contractor and request that they evaluate your problem, but they must call us for authorization prior to performing service. Your service contractor must be licensed and insured. After authorization has been provided, you must send the acceptable proof of your actual itemized costs to 2-10 HBW before any reimbursement amount will be paid. 2. In some instances we may provide payment instead of performing a repair or replacement service when, including but not limited to: (i) the cost of completing a repair or replacement exceeds the stated “DOLLAR LIMIT”; or (ii) even after repair or replacement, the system or appliance remains non-compliant with laws, regulations or code requirements; or (iii) the system or appliance is subject to a manufacturer’s recall for a defect unrelated to the covered breakdown. a. If we elect payment, the amount will equal the lesser of: (i) what the ordinary customer would pay after negotiating the best price for such services in your area and without the benefits of this Service Agreement; or (ii) the amount we would pay for parts and labor for covered service based upon our contracts with service contractors (this amount is usually less than retail cost or your actual cost); or (iii) the “DOLLAR LIMIT” reduced by the service fee paid to the service contractor by you and the cost incurred to diagnose the malfunction. b. We may elect payment in lieu of repairs in any particular instance. Such payments are typically made subject to restrictions. Some or all of such payment may be paid to you or a service contractor. We are not responsible for work performed by you when payment has been provided in lieu of services. 3. We support the utilization of environmental and ozone friendly alternatives to HCFCs refrigerants. The service contractor may use these refrigerants when repairing or replacing equipment that uses HCFCs refrigerants. Particularly for equipment currently using R-22 as a refrigerant. The service contractor will select a preferred refrigerant based upon its ability to approximate the HCFC refrigerant being replaced, its availability, application and any applicable regional criteria.

Providing Service. The Seller is obliged to provide free warranty service for all delivered goods under the conditions set forth in this Article of this Contract and the terms and conditions agreed between the Seller and the Buyer. The Seller is obliged to provide service for all the subject of performance according to the Specification of the Subject of Performance, by providing the Buyer within 48 hours of reporting the defect (malfunction) to the Buyer on the working days the manner and expected time of defect (malfunction) removal that the removal of the defect (malfunction) itself must be initiated by the Seller within two weeks of its notification at the latest. The Service and repairs must preferably be performed by the Seller at the place of performance in accordance with the Article V. paragraph 2 of this Contract. The notification of the defect is considered to be a telephone notification and subsequently a written (electronic via e-mail) notification of the defect to the Seller. At the same time, this declaration means the claim in accordance with the Article VIII. of this Contract. In the defect notification, the Buyer shall provide a description of the defect or information on how the defect manifests itself. The commencement of the repair is considered to be the real commencement of the real start of work on the reported defect. In the event that the Seller commenced the relevant work to remove the defect within the period specified in paragraph 2 of this Article of this Contract, but did not do so within the required time, the Buyer shall be entitled to have the said work performed by a third party. The Seller is also obliged to pay the related costs to the Buyer within 10 days of receiving a written call for payment and an invoice. The same applies to default interest. Providing Service. If the technical support team determines that the Customer has a valid warranty claim, the technical support team will determine, in its sole discretion, whether to repair or replace the Hardware. The technical support team will also determine, in its sole discretion, whether to provide warranty service: (a) on site (by a certified technician); (b) through communication with the Customer; and/or (c) through shipment of the Hardware to SAFARI Montage facilities.
