Common use of PROVISION OF SOLUTIONS Clause in Contracts

PROVISION OF SOLUTIONS. 6.1 Xxxxxx will provide, and the Account Holder will receive and have use of, the Solutions and related Deliverables in accordance with the Agreement for the Term or Order Term (as may be applicable). 6.2 Xxxxxx shall provide, deliver or otherwise make available the Solution(s) and/or Deliverable(s) with reasonable skill and care, in a timely manner and in accordance with the provisions of the Agreement (including any relevant Services Modules and Documentation). Notwithstanding clauses 19.1 to 19.3 of these Terms, in the event of any breach of this clause, Xxxxxx will at its sole expense use commercially reasonably endeavours to re-supply the relevant Solution and/or Deliverable in a manner which conforms to this clause. This shall be the Account Holder’s sole and exclusive remedy for such breach.
