Purchase Contract Does Not Include Forecasts; Maintaining Capacity. Any expression of quantities of Products or Services noted by Buyer in its requests for quotes or statements of work for materials or components are to be considered non-binding information serving only to enable Seller to plan for capacity and materials, will not be considered a term of the Purchase Contract, and will not obligate Buyer to purchase the quantity indicated. Notwithstanding the previous sentence, Seller agrees to maintain staffing, equipment and other production or services resources sufficient to exceed by 25% its agreed- upon capacity plan as described by Xxxxx in its statement of work. Buyer may express quantities of Products or Services as part of a binding performance specification in its requests for quotes or statements of work for packaging, tooling or equipment.
