Common use of PURCHASE OF GOODS, WORKS OR SERVICES Clause in Contracts

PURCHASE OF GOODS, WORKS OR SERVICES. 7.1 Rules for purchasing goods, works or services 7.1.1 If necessary to implement the specific action, the partner may purchase goods, works or services. The partner must make such purchases ensuring the best value for money or, if appropriate, the lowest price. In doing so, it must avoid any conflict of interests (see Article 25 FPA). The partner must ensure that the Agency, the Commission, the European Court of Auditors (ECA) and the European Anti-Fraud Office (OLAF) can exercise their rights under Articles 22 and 23 FPA also towards its contractors. 7.1.2 If the partner is a ‘contracting authority’ within the meaning of Directive 2004/18/EC9 (or 2014/24/EU10) or ‘contracting entity’ within the meaning of Directive 2004/17/EC11 (or 2014/25/EU12) it must comply with the applicable national law on public procurement.
