Qualifications and Certification. (a) Whenever a certificate is required by the Laws of Saskatchewan or this agreement as a condition of employment, the certificate shall be one issued or approved by the Province of Saskatchewan. Such certificates must be presented to the Human Resources Section as required.
(b) Building Operators shall hold a Caretaker Fireman Certificate unless the school plant requires a 5th Class or higher Engineer Certificate as issued by the Saskatchewan Ministry of Labour.
(c) Where Building Operators require a 5th Class Engineer Certificate, Caretakers who have completed or show promise to complete the Building Operator Training Program shall be eligible for reimbursement of 50% of the cost of obtaining the initial 5th Class certification. The cost of subsequent renewal shall be the responsibility of the employee.
(d) Any new certificates required by the Board or governing authority, due to new duties, equipment or duties assigned to employees, shall be paid for by the Board. The cost of subsequent renewal of such certificates shall be the responsibility of the employee. This clause shall only apply to employees currently in the affected position.
(a) In exceptional circumstances, should it become apparent that a new assignment is in the best interests of the students, the Board and the employee; an administrative initiated transfer can be initiated. Prior to initiating this transfer, the Board would engage in consultation and dialogue with the employee and the Union outlining the rationale for the move and the benefits of a new placement for all affected by such move. Variables which would be considered exceptional circumstance could include; changing needs of the school and/or division, and the need for growth opportunity for the employee.
(b) This transfer would take effect at the time which best meets the needs of all parties and the appropriate support would be provided to the employee to assist with a smooth transition to their new assignment. Where ever possible the transfer would take place at the beginning of the following school year or at a natural school break.
(c) Positions in all groups except Group E which become vacant as a result of Administrative Initiated Transfers will be posted as per 15:01. Transfers within the vacant job classification will occur prior to promotion or increase in FTE’s. The employee affected by an Administrative Initiated Transfer will be considered for all subsequent vacancies arising out of the initial posting.

Qualifications and Certification. Employment practices shall be governed by the relevant laws of the State of Idaho. These laws include, but are not limited to Idaho Code Sections 33-513 through 33-518, and sections 33-130, and 33-5205 (3)
Qualifications and Certification. The services under this Agreement shall be performed only by qualified professionals acting within the scope of their applicable license or certification and the laws and regulations of New York State. The services provided by Xxxxxxxxx Xxxxx y pursuant to this Agreement shall at all times comply with all applicable laws and regulations governing the provision of such services. Charlotte Valley shall comply with prevailing standards of care in the community with respect to the provision of services to the Student. It shall further be the responsibility of C x x x x x x x x X x x x x x to ensure that all required criminal history checks for staff are completed, and to provide Jefferson Central School with proof of the same, upon request.
Qualifications and Certification. The parties signatory hereto have established a Certification Program for all operators of cranes in excess of a 7.5-ton lifting capacity or 25 feet of boom length. A committee of not less than three (3) management representatives and three (3) union representatives selected by established program procedures will manage and oversee the program’s operations.

However the validity of the certificate always remains your responsibility. We advise Homeowners to request sight of evidence of applicable trade accreditations or registrations, and to perform any relevant checks prior to work commencing on a project or job. You agree to comply with any reasonable requests submitted by the Homeowners with regards to the verification of such accreditations, registrations or information. Any checks on trade accreditations or registrations that we carry out do not reduce your obligation to ensure that all your subcontractors and any personnel involved in the project or job have the required trade accreditation or registration to carry out specific aspects of the project or job.
Qualifications and Certification. The Interim Superintendent represents that he has the proper qualifications and certification as required by the Board of Education and the State of Michigan to serve in the capacity of Interim Superintendent and as K-12 Principal at the time of signing this Contract.
A. The Interim Superintendent further agrees that he shall maintain the proper qualifications and certification while serving pursuant to this Contract or it shall immediately become void and of no effect.
B. This Contract is terminable if it is determined by the Michigan Department of Education, or other proper authority, that the Interim Superintendent does not possess the requisite certification/qualifications to perform the responsibilities associated with his position. It is the intent of this provision to enable the School District to comply with applicable state laws and rules pertaining to the certification/qualifications pertaining to the position of Superintendent and to avoid any jeopardy to the operation of funding of the School District or subjecting the Board of Education, its members or the School District to any fines, penalties or sanctions of any nature.
C. The presence of the stipulations in this section, Qualifications and Certification, shall in no way be construed or regarded as a limitation upon the at-will employment relationship specified in this Contract.
