Common use of Qualifications and Licenses Clause in Contracts

Qualifications and Licenses. All design, professional, and engineering Services furnished by or on behalf of the Engineer shall be performed by persons qualified to perform the Services assigned to them and shall be under the responsible charge of the Engineer licensed to practice their respective trades or professions, where required by law, and who shall assume professional responsibility for all programming, design, calculations, and related engineering documents, hereinafter defined, prepared or furnished by them. Engineer’s Representative, Key Personnel, and Consultants shall be experienced in projects of similar nature and complexity to the subject Project and shall be approved by Owner prior to their assignment to the Project. Engineer shall provide current information on the professional background of its Representative, Key Personnel, and Consultants upon request by Owner.
