QUALIFYING PERSONS. 11.1 It is the intention of the Seller that only persons 50 (fifty) years and older shall occupy the sections of the development scheme relating to the housing development scheme. If the Occupier is married or deemed to be in a permanent relationship at the date of occupation referred to in clause 7 hereof and any one of the spouses/life-partners qualifies in terms of this clause, both parties qualify. 11.2 100% (one hundred per cent) of the total number of units with regard to the housing development scheme shall be made available for occupation to retired persons as defined in the Housing Development Schemes for Retired Persons Act only. This means that should a unit be sold to a person or persons younger than 50 (fifty) years or to a company, close corporation or trust, the unit may only be occupied by retired persons as stipulated in clause 11.1 hereof. 11.3 The Purchaser will not be entitled to alienate, lease or make over any of its rights acquired in terms of this agreement, should such alienation or lease have the effect that the unit is occupied by (a) person(s) not complying with the age restrictions as set out in clause 11.1 hereof, or any of the other conditions contained herein. The Purchaser’s successors in title will also be subjected to the conditions affecting the Purchaser as set out in this agreement and as contained in the Rules of the housing development scheme.

12.4 The age restriction expressly noted under the provisions of clauses 12.1 to 12.3 shall not apply if all the members of the Waterkloof Marina Retirement Estate Home Owners Association consent, in writing, to any person below the age of 50 (fifty) to occupy a unit.
