Common use of Quality and Description Clause in Contracts

Quality and Description. Subject to Clause 14 the Goods shall: (1) conform as to the quantity, quality and description with the particulars stated in the Order; (2) be of sound materials and good workmanship; (3) be capable of any standard of performance specified in the Order and/or specification; (4) if the purpose for which they are required is indicated in the Order either expressly or by implication be fit for that purpose; and (5) maintain safe working condition at all times and comply with workplace health and safety and environmental laws & regulations and company’s guidelines and regulations pertaining to health, safety, environment and security.
