Common use of Quality and use of water Clause in Contracts

Quality and use of water. 5.1 No warranty by the Water Entity (a) The Water Entity makes no warranty to the Land Holder as to the condition, quality, fitness for purpose of or any contamination in any Scheme Water. (b) The Land Holder acknowledges that the Water Entity has no obligation to monitor the condition, quality or fitness for purpose of or any contamination in, the Scheme Water and any such monitoring will not prejudice the rights of the Water Entity or relieve the Land Holder from its obligations and liabilities under this agreement.
