Common use of Quality of Materials Clause in Contracts

Quality of Materials. The Construction Manager shall furnish goods, products, materials, equipment and systems which: 5.1.1 Comply with this Agreement; 5.1.2 Conform to applicable specifications, descriptions, instructions, drawings, data and samples; 5.1.3 Are new (unless otherwise specified or permitted) and without apparent damage; 5.1.4 Are of quality, strength, durability, capacity or appearance equal to or higher than that required by the Construction Documents; 5.1.5 Are merchantable; 5.1.6 Are free from defects; and 5.1.7 Are beyond and in addition to those required by manufacturers' or suppliers' specifications where such additional items are required by the Construction Documents.
