Quality of Materials andworkmanship The Contractor shall ensure that the Construction, Materials and workmanship are in accordance with the requirements specified in this Agreement, Specifications and Standards and Good Industry Practice.
Quality of Materials. In order to establish standards of quality, the Engineer has, in the detailed specifications, referred to certain products by name and catalog number. This procedure is not to be construed as eliminating from competition other products of equal or better quality by other manufacturers where fully suitable in design.
a) The Contractor shall furnish the complete list of proposed desired substitutions prior to signing of the contract, together with such engineering and catalog data as the Engineer may require.
b) The contractor shall abide by the Engineer's judgment when proposed substitute materials or items of equipment are judged to be unacceptable and shall furnish the specified material or item of equipment in such case. All proposals for substitutions shall be submitted in writing within a reasonable time. No substitute materials shall be used unless approved in writing.
c) An addendum will be issued prior to bid opening, identifying manufacturers of approved equipment. Only general contractors can request approval of equal equipment.
Quality of Materials. In the absence of detailed Specifications, all Materials and Equipment shall conform to the latest standards of the American Society for Testing Materials available at the time notice inviting Contractors to Bid is published (the Advertisement For Bids) unless otherwise indicated.
Quality of Materials. The General Contractor shall furnish goods, products, materials, equipment and systems which:
(i) comply with this Contract For Construction;
(ii) conform to applicable specifications, descriptions, instructions, drawings, data and samples;
(iii) are new (unless otherwise specified or permitted) and without apparent damage;
(iv) are of quality, strength, durability, capacity or appearance equal to or higher than that required by the Construction Documents;
(v) are merchantable;
(vi) are free from defects; and
(vii) are beyond and in addition to those required by manufacturers' or suppliers' specifications where such additional items are required by the Construction Documents.
Quality of Materials. Contractor warrants that all materials used in the construction of the Project shall be new or repaired as indicated and all workmanship and materials used in the construction of the Project shall be of good quality, free from faults and defects and, in conformity with the Contract documents unless otherwise specified in the Contract. All Work not conforming to these standards shall be considered defective.
Quality of Materials. The Construction Manager shall furnish goods, products, materials, equipment and systems which:
5.1.1 Comply with this Agreement;
5.1.2 Conform to applicable specifications, descriptions, instructions, drawings, data and samples;
5.1.3 Are new (unless otherwise specified or permitted) and without apparent damage;
5.1.4 Are of quality, strength, durability, capacity or appearance equal to or higher than that required by the Construction Documents;
5.1.5 Are merchantable;
5.1.6 Are free from defects; and
5.1.7 Are beyond and in addition to those required by manufacturers' or suppliers' specifications where such additional items are required by the Construction Documents.
Quality of Materials. It is the intent of these specifications that first class materials shall be used throughout the work, . and that they shall be incorporated in such a manner as to produce completed construction which is workmanlike and acceptable to the Superintending Engineer in every detail. Only materials which conform to the requirements of these specification shall be furnished or incorporated in the work. The contract shall upon the request of the Superintending Engineer furnish him with the vouchers to prove that the materials are such as specified. Samples of materials with test certificate have to be furnished at the contractors expenses for the approval of the SE. I E.E. prior to the execution of any work.
Quality of Materials. SSA Orangewood Children & Family Center Facilities Manager may require Contractor to furnish data and/or samples of chemicals or cleaning agents that Contractor is using or intends to use on the premises. SSA Orangewood Children & Family Center Facilities Manager, at its sole discretion, may prohibit use of any such chemical or cleaning agent and Contractor will be required to provide an alternate chemical or agent that is acceptable.
Quality of Materials. The DB shall furnish goods, products, materials, equipment and systems which:
5.1.1 comply with this Contract;
5.1.2 conform to applicable specifications, descriptions, instructions, drawings, data and samples;
5.1.3 are new (unless otherwise specified or permitted) and without apparent damage;
5.1.4 are of quality, strength, durability, capacity or appearance equal to or higher than that required by the Construction Documents;
5.1.5 are merchantable;
5.1.6 are free from defects; and
5.1.7 are beyond and in addition to those required by manufacturers' or suppliers' specifications where such additional items are required by the Construction Documents.
Quality of Materials. All materials, fixtures, fittings, supplies and equipment furnished under the Contract shall be new and unused, of standard first-grade quality and of the best workmanship and design.
