Common use of Recipient created tax invoice Clause in Contracts

Recipient created tax invoice. (a) The Recipient will issue a Recipient Created Tax Invoice in respect of such Taxable Supply at or before the time of payment of the consideration for the supply as increased on account of GST under clause 7. l(d) or at such other time as the parties agree. (b) The Housing Agency will in respect of the Taxable Supply pay to the Supplier the amount shown on such RCTI at the time and in the manner described in Schedule 1 of this Agreement. (c) For purposes of any Recipient Created Tax Invoice: (i) The Recipient is Family and Community Services - Housing NSW ABN 84 608 917 940 (ii) The Supplier making Taxable Supplies to the Recipient is the Provider. (iii) The Supply to which this agreement relates is the provision ofproperty and tenancy management services and the acquisition ofproperties. (d) The Supplier warrants that: (i) it is registered for GST when it enters into this agreement; (ii) it will notify the Recipient if the Supplier ceases to be registered for the GST; (iii) the Recipient may issue Tax Invoices in respect of the above mentioned supplies; and (iv) it will not issue Tax Invoices to the Recipient for supplies made to the Recipient. (e) The Recipient warrants that: (i) it is registered for the GST when it enters into this agreement; (ii) it will notify the Supplier if the Recipient ceases to be registered for the GST; and (iii) it will not issue a document that would otherwise be an RCTI, on or after the date when the Recipient or the Supplier has failed to comply with any of the requirements of the determination attached to Tax Ruling GSTR2000/10. (f) Certain terms used in this clause 7 are defined in clause 8.2 of this Agreement

Recipient created tax invoice. For the purpose of satisfying the requirements of the GST legislation and any additional requirements as determined by the Commissioner of Taxation from time to time, the parties agree that: (a) The Recipient unless the Adviser Group notifies the Product Issuer to the contrary, the Product Issuer will issue Recipient Created Tax Invoices in respect of taxable supplies made by the Adviser Group to the Product Issuer under this agreement; and (b) the Adviser Group will not issue a Tax Invoice in respect of any supply by the Adviser Group to the Product Issuer under this agreement unless the Product Issuer notifies the Adviser Group that the Product Issuer will not be issuing a Recipient Created Tax Invoice in respect of such Taxable Supply at or before the time of payment of the consideration for the supply as increased on account of GST under clause 7. l(d) or at such other time as the parties agree. The Product Issuer will notify the Recipient if Adviser Group in the Supplier event that the Product Issuer ceases to be registered for GST purposes or ceases to satisfy the GST; (iii) the requirements for issuing Recipient may issue Created Tax Invoices as set out in respect the GST legislation or as determined by the Commissioner of the above mentioned suppliesTaxation from time to time; and (ivd) it will not issue Tax Invoices to the Recipient for supplies made to the Recipient. (e) The Recipient warrants that: (i) it Adviser Group is registered for GST purposes when this agreement is entered into and has notified the GST when it enters into this agreement; (ii) it Product Issuer of its ABN. The Adviser Group will notify the Supplier if Product Issuer in the Recipient event that the Adviser Group ceases to be registered for GST purposes or the GSTAdviser Group becomes aware of any reason why its registration may be cancelled; and (iiie) it if the Adviser Group ceases to be registered, the Product Issuer will not issue a document that would otherwise immediately cease paying any amount on account of GST to the Adviser Group in respect of any supplies made by the Adviser Group to the Product Issuer under this agreement, and any consideration expressed to be an RCTI, on or after the date when the Recipient or the Supplier has failed inclusive of GST is to comply with any of the requirements of the determination attached to Tax Ruling GSTR2000/10be reduced accordingly. (f) Certain terms used in this clause 7 are defined in clause 8.2 of this Agreement

(iii) The Supply to which this agreement relates is the provision ofproperty and tenancy management services and the acquisition ofproperties.future changes made; (d) The Supplier warrants that: (i) HAULR Delivery acknowledges that it is registered for GST when it enters into this agreement; (ii) and that it will notify the Recipient Affiliate Partner if the Supplier it ceases to be registered for GST or if it ceases to satisfy any of the GST; (iii) the requirements necessary for it to be entitled to issue Recipient may issue Created Tax Invoices in respect of the above mentioned supplies; and (iv) it will not issue Tax Invoices to the Recipient for supplies made to by the Recipient.Referral Partner under these Terms; (e) The Recipient warrants that: (i) it is registered for the GST when it enters into this agreement; (ii) it will notify the Supplier if the Recipient ceases to be registered for the GST; and (iii) it will HAULR Delivery must not issue a document that would otherwise be an RCTI, a Recipient Created Tax Invoice on or after the date when the Recipient HAULR Delivery or the Supplier Affiliate Partner has failed to comply with any of the applicable requirements of the determination attached to Commissioner of Taxation in respect of Recipient Created Tax Ruling GSTR2000/10.Invoices; (f) Certain terms used HAULR Delivery indemnifies the Affiliate Partner for any liability for GST and penalty that may arise from an understatement by HAULR Delivery, on a tax invoice it issues, of the GST payable on any of the specified supplies received; (g) the Affiliate Partner indemnifies HAULR Delivery for any liability for GST and penalty that may arise from any breach or non-compliance with sub-clauses (b) or (c) above, or any act or omission that causes (directly or indirectly) HAULR Delivery to be in breach of its requirements under A New Tax System (Goods and Services Tax) Xxx 0000 (Cth); and (h) HAULR Delivery agrees that it will provide a Recipient Created Tax Invoice at the same time as payments are made to the Affiliate Partner under this clause 7 are defined in clause 8.2 of this Agreement3.
