Recognition - Bargaining Unit. Pursuant to and in accordance with all applicable provisions of Act 379 of the Public Acts of 1965, as amended, the Employer does hereby recognize the Union as the exclusive representative for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment for the term of this Agreement of all employees of the Employer included in the bargaining unit described below in 1.1a.

Excluded: All management level employees, professional employees, confidential employees, students, guards, and supervisors defined by the act, seasonal and casual employees as defined by the State Employment Relations Board, the elected officials, employees of other elected County officials, technical employees, office employees, clerical employees, and employees in all other classifications not specifically included in the inclusion above. If the Employer creates a new bargaining unit position, the parties shall meet for the purpose of determining the wage rate for these positions. If the parties cannot agree on the wage rate, the Employer will have the right to set the rate of pay and that rate will be subject to negotiations when the next contract is bargained. If the Employer creates a new classification and the parties are unable to agree whether the position is to be included in the bargaining unit, the parties will petition SERB to seek a determination.
Recognition - Bargaining Unit. 3.1 If at any time during the term of this Agreement, the Union shows proof, or offers to show proof, that a majority of the Employer’s employees covered by the labor agreement support the Union and have authorized the Union to serve as their collective bargaining representative, the Employer will immediately (within five days) recognize the Union under Section 9(a) of the National Labor Relations Act as the sole and exclusive bargaining representative of all employees within the craft and geographical scope of the labor agreement.
