Recognition - Bargaining Unit. 1. 021 The Board hereby recognizes that PACE, an affiliate of the Ohio Education Association (OEA), the Southwestern Ohio Education Association (SWOEA), and the National Education Association (NEA), is the sole and exclusive bargaining agent for all certified personnel employed by the Board as set forth below.
1. 022 The group of represented employees shall be referred to herein as the “bargaining unit” and any teacher represented as a member of the bargaining unit shall be referred to herein as a “member”. The bargaining unit shall be defined as including: all full and regular part-time certificated personnel including all teachers, substitute teachers holding a valid teaching certificate on a salaried regular contract basis, counselors, media specialists, nature center personnel, nurses, librarians, psychologists, speech and hearing specialists, hourly paid tutors, teachers in the pre-school, and auxiliary services teachers excluding: management-level employees, supervisors and confidential employees as defined in Ohio Revised Code (ORC) Section 4117.01, substitute teachers who are not on a salaried regular contract basis, persons who no longer hold valid certificates, persons employed less than thirty (30) days pending receipt of background check and criminal record investigation, and all other employees.
1. 023 The rights granted herein to PACE shall not be granted or extended to any competing labor organization.
Recognition - Bargaining Unit. Pursuant to and in accordance with all applicable provisions of Act 379 of the Public Acts of 1965, as amended, the Employer does hereby recognize the Union as the exclusive representative for the purpose of collective bargaining in respect to rates of pay, wages, hours of employment, and other conditions of employment for the term of this Agreement of all employees of the Employer included in the bargaining unit described below in 1.1a.
Recognition - Bargaining Unit. 2.1 The Board recognizes the Federation as the exclusive bargaining representative on wages, hours and conditions of employment for all employees described in Articles 1.5, 1.6 and 1.7 of this Agreement.
2.2 Confidential, Supervisory, Management, Faculty and Academic Professional employees, as defined in Articles 1.3, 1.4, 1.8, 1.9, 1.10, 1.20 and 1.21, shall be excluded from the bargaining unit.
2.3 Management shall provide notice to the Federation whenever a bargaining unit job is designated as Confidential (Article 1.8) or Supervisory (Article 1.9).

The City recognizes the Union as the sole and exclusive bargaining agent for the purposes of collective bargaining with respect to wages, hours and other conditions of employment for all regular full-time and regular part-time positions in the Public Works Department in the classifications listed below, but specifically excluding all others. Recognition - Bargaining Unit. Consistent with SERB Case No. 2016-REP-09-0082, the Board recognizes the Union as the exclusive collective bargaining representative for a bargaining unit composed of all regularly employed school bus drivers. All other employees, including all management level employees, supervisors, confidential employees, and casual/seasonal employees as defined by Ohio Revised Code Chapter 4117, as well as all employees represented by another labor organization, are excluded from the bargaining unit.

The City recognizes the Union as the sole and exclusive bargaining agent for the purposes of collective bargaining with respect to wages, hours, and other conditions of employment for all full-time and regular benefited part-time employees of the Cambridge Inspectional Services Department in the following classifications: Sanitary/Housing Inspector, Sanitary/Housing Inspector Constable, Assistant Sanitary Inspector, Plumbing and Gas Inspector, Building Inspector, Assistant Building Inspector, Wire Inspector, Zoning Specialist, Access Analyst, Code Enforcement Inspector, Code Inspector/Constable, Zoning and Building Associate, and Compliance Inspector employed by the Cambridge Inspectional Services Department, and excluding all other Inspectional Services employees.
Recognition - Bargaining Unit. The County hereby recognizes the Union as the sole and exclusive bargaining agent for the purpose of collective bargaining on matters related to wages, hours, or terms and other conditions of all employees (also referred to as "members") in the bargaining unit listed in this Article. The bargaining unit shall consist of the following, as certified in SERB Case No. 2021-REP-06-0059: Included: Service and maintenance employees in the following classifications: Auto Mechanic I, Assistant Auto Mechanic, Auto Service Worker II, Body Shop Repair Worker, Bridge Utility Worker I, II, and III, Building Maintenance Worker I and II, Custodian, Electrician, Equipment Operator I, II, and III, Grounds Maintenance Worker, Highway Maintenance ▇▇▇▇▇▇▇, Security Officer, Signal Electrician Inspector, Storekeeper I, Mobility Worker I and II; Mobility Clerk; Mobility Electrician; and Vactor Crew ▇▇▇▇▇▇▇. Excluded: All management level employees, professional employees, confidential employees, students, guards, and supervisors defined by the act, seasonal and casual employees as defined by the State Employment Relations Board, the elected officials, employees of other elected County officials, technical employees, office employees, clerical employees, and employees in all other classifications not specifically included in the inclusion above. If the Employer creates a new bargaining unit position, the parties shall meet for the purpose of determining the wage rate for these positions. If the parties cannot agree on the wage rate, the Employer will have the right to set the rate of pay and that rate will be subject to negotiations when the next contract is bargained. If the Employer creates a new classification and the parties are unable to agree whether the position is to be included in the bargaining unit, the parties will petition SERB to seek a determination.
Recognition - Bargaining Unit. 3.1 If at any time during the term of this Agreement, the Union shows proof, or offers to show proof, that a majority of the Employer’s employees covered by the labor agreement support the Union and have authorized the Union to serve as their collective bargaining representative, the Employer will immediately (within five days) recognize the Union under Section 9(a) of the National Labor Relations Act as the sole and exclusive bargaining representative of all employees within the craft and geographical scope of the labor agreement.
3.2 The Union, and all independent Contractors who have agreed to abide by the wages, hours, terms and conditions of employment set forth in this Agreement do hereby agree to establish and recognize a single Employer collective bargaining unit for each signatory Employer. The Union recognizes the Employer’s designated representative as the authorized bargaining agent for those Employers in the Drywall and Painting Industry operating within the territorial area covered by this Agreement for the type of work covered by this Agreement who have or hereafter sign this Agreement.
3.2.1 Employers covered by this Agreement shall be free to designate their own representative for the purpose of collective bargaining; however, such designation shall not affect the Employer’s right or obligation to make Trust or Fund contributions required by this Agreement.

The City recognizes the Union as the sole and exclusive bargaining agent for the purposes of collective bargaining with respect to wages, hours, and other conditions of employment for all full-time and regular part-time employees of the Cambridge Water Department in the following classifications: cross-connection inspectors, cross-connection supervisors, meter technicians, meter technician supervisors, reservoir caretakers, working supervisors, construction inspectors, water system maintenance crafts- workers, skilled laborers, laborers, motor equipment operators, motor equipment repair-workers, inventory control specialists, motor equipment operators – operations specialist, and excluding all other employees, including, but not limited to, treatment plant operators, filter operators, working foreperson, machine maintenance, superintendent, managing director, distribution supervisors, business manager, chief ranger, ranger, master mechanic, manager of water resources, manager of distribution, assistant manager of distribution, manager of engineering, supervisor of water quality, assistant water quality supervisor, watershed manager, manager of operators, administrative assistants, fiscal coordinator, office clerical staff, interns and co-op students, other supervisors, accountants, engineers, chemists, seasonal employees, co-op students, interns and managerial and confidential employees.
Recognition - Bargaining Unit. 2.01 The Company recognizes the Union as the sole and exclusive Bargaining Agent of all Employees of Custom Foam Systems Ltd. at Kitchener, save and except ▇▇▇▇▇▇▇, persons above the rank of ▇▇▇▇▇▇▇, office and sales staff, and students employed during June, July and August.
