RECOGNITION (Prior Article 2). ‌ The Employer recognizes the Association as sole and exclusive bargaining agent for all employees within the appropriate bargaining units, both existing and to be determined in the future, for which the Association is certified or recognized, except temporary employees and those employees excluded by law or by determination of the Employment Relations Board (XXX). Classifications represented by the Association within the Oregon Department of Transportation (ODOT), the Oregon Parks and Recreation Department (OPRD) and the Department of Forestry (Forestry) are listed in Appendix B, including such other classes as may from time to time be determined as appropriate through the Employment Relations Board process. The Employer shall notify the Association when the Agency excludes a filled bargaining unit position based on supervisory, managerial or confidential status. Any dispute regarding such exclusions shall be resolved by the Employment Relations Board.
