Common use of Reconveyance Clause in Contracts

Reconveyance. Upon Beneficiary's written request, and upon surrender to Trustee for cancellation of this Deed of Trust or a certified copy thereof, Trustee shall reconvey or release, without warranty, the Subject Property or that portion thereof then held hereunder. To the extent permitted by law, the reconveyance or release may describe the grantee as "the person or persons legally entitled thereto" and the recitals of any matters or facts in any reconveyance or release executed hereunder shall be conclusive proof of the truthfulness thereof. Neither Beneficiary nor Trustee shall have any duty to determine the rights of persons claiming to be rightful grantees of any reconveyance or release. When the Subject Property has been fully reconveyed or released, the last such reconveyance or release shall operate as a reassignment of all future rents, issues and profits of the Subject Property to the person or persons legally entitled thereto.

Upon Beneficiary's receipt by Trustor and Beneficiary of written requestnotice from the Trustee that the Obligations have been paid in full or that there has been a Transfer of a portion of the Property as permitted under the Transaction Documents, and upon surrender to then Beneficiary shall request that Trustee for cancellation of this Deed of Trust or a certified copy thereof, Trustee shall reconvey or releasereconvey, without warranty, the Subject Property or that the applicable portion thereof then held hereunderthereof.
