Recreation Leave Loading Clause Samples
The Recreation Leave Loading clause provides employees with an additional payment, typically a percentage of their base pay, when they take annual or recreation leave. This extra payment is designed to compensate for the potential loss of regular overtime or penalty rates that employees might otherwise earn if they were working instead of on leave. By including this clause, employers ensure that employees are not financially disadvantaged during their leave periods, thereby encouraging the use of annual leave and supporting employee well-being.
Recreation Leave Loading. This is clause 54 in the current Agreement. There is a minor change to the reporting period reference regarding the Australian Statistician’s Northern Territory male average weekly total earnings to change from June quarter to May reference period.
Recreation Leave Loading. This is equivalent to clause 59 in the current Agreement with a minor change to current clause 59.2(a) in new clause 57.2(a): shiftworkers will be an exception to the rule that an employee is required to utilise one week of recreation leave to be entitled to recreation leave loading. There is a new explanatory note below clause 57.1(b) directing to new clause 44.4 for more information on shiftwork penalties payable on recreation leave.
Recreation Leave Loading. 39.1 Recreation leave loading entitlement
(a) In addition to normal salary payment for recreation leave, an employee is entitled to a recreation leave loading on 1 January each year. The amount of the loading will be the lesser of:
(b) 17.5% of the value of the annual recreation leave accrued over the previous year based on the employee’s salary, including allowances in the nature of salary; or
(c) a maximum payment the equivalent of the Australian Statistician’s Northern Territory male average weekly total earnings for the June quarter of the previous year.
39.2 Payment of recreation leave loading
(a) An employee who is approved to use at least one week of recreation leave may apply for an accrued recreation leave loading.
(b) On cessation of employment an employee is entitled to payment in lieu of any unpaid leave loading plus a pro rata payment of the leave loading entitlement at 1 January of the year of cessation for each completed month of service.
(c) Where an employee commenced and ceased employment in the same year, the employee’s salary for purposes of calculation of the leave loading at clause 39.2(b) will be the salary payable had the employee been employed on 1 January of that year.
Recreation Leave Loading. This is clause 82 in the current Agreement. There is no substantive change to this clause.

(a) In addition to normal salary payment for recreation leave, an employee is entitled to accrue a recreation leave loading on 1 January each year. Subject to clause 57.1(b) the amount of the loading will be the lesser of:
(i) 17.5% of the value of the annual recreation leave accrued over the previous year based in the employee’s salary, including allowances in the nature of salary; or
(ii) a maximum payment the equivalent of the Australian Statistician’s Northern Territory male average weekly total earnings for the September quarter of the previous year.
(b) In the case of a shiftworker who would have been entitled to shiftwork penalties in excess of the maximum payment referred to in clause 57.1(a)(ii) had the employee not been on recreation leave, the amount of the recreation leave loading will be equivalent to the shiftwork penalties payable on recreation leave. Note: Refer clause 44.4 for shiftwork penalties payable on recreation leave.

(i) seventeen and a half percent of the value of the annual recreation leave accrued over the previous year based on the employee’s salary, including allowances in the nature of salary; or
(ii) a maximum payment the equivalent of the Australian Statistician’s Northern Territory male average weekly total earnings for the September quarter of the previous year.
(b) In the case of a shift worker who would have been entitled to shift penalties in excess of the maximum payment referred to in paragraph 59.1(a)(ii) had the employee not been on recreation leave, the amount of the recreation leave loading will be equivalent to the average shift penalties paid to an employee in the six months preceding the period of recreation leave to be taken.
59.2 Payment of recreation leave loading
(a) An employee who is approved to use at least one week of recreation leave may apply for payment of an accrued recreation leave loading.
(b) On cessation of employment an employee is entitled to payment in lieu of any unpaid leave loading plus a pro rata payment of the leave loading entitlement at 1 January of the year of cessation for each completed month of service.

Recreation Leave Loading. Full-time employees shall be paid a recreation leave loading in respect of 140 hours leave entitlement equal to 17.5 per cent of the ordinary pay of the employee with a maximum payment equal to the Australian Statistician’s figure for Average Weekly Earnings of all Males (Australia) as reported in June of the year in which the entitlement to the leave is accumulating. Leave loading shall be paid at the time leave is taken. Employees who are employed on a part-time basis shall receive payment for the annual leave loading on a pro rata basis.
