Common use of Refund of Deposit Clause in Contracts

Refund of Deposit. Except to the extent that (i) Landlord uses the Security Deposit to cure a default of Tenant, to pay damages for Tenant’s breach of the Lease, or to restore the Premises to the condition to which Tenant is required to leave the Premises upon the expiration or any termination of the Lease, and (ii) such amounts are not replenished by Tenant, then Landlord shall, within sixty (60) days after the Expiration Date or any termination of this Lease, refund to Tenant the Security Deposit. Tenant may not credit the Security Deposit against any month’s Rent. Upon any reduction of the required Security Deposit amount, as set forth in Section 1(g), Landlord shall, within thirty (30) days after any such reduction, refund to Tenant that portion of the Security Deposit as is necessary to reduce the Security Deposit to the required amount.
