Refusal of application. The Allocation Platform may refuse to enter into a Participation Agreement with a market participant in the following circumstances: (a) when the applicant has not submitted a duly completed and signed Participation Agreement in accordance with Articles 6, 7 and 8; or (b) the Allocation Platform has previously terminated a Participation Agreement with the applicant as a result of a breach of the Participation Agreement by the Registered Participant in accordance with Article 56 (3) and (4) and unless the circumstances leading to termination have ceased to exist or the Allocation Platform is reasonably satisfied that the breach will not occur again; or (c) if entering into a Participation Agreement with the applicant would cause the Allocation Platform to breach any condition of any mandatory legal or regulatory requirement; or (d) if any of the warranties of the Registered Participant under Article 9 are found to be not valid or false; or (e) if the applicant is under economic and trade sanctions which may have significant impact to the Allocation Platform.
