Regarding Exhibits. Any exhibits not available or attached to this Agreement at the time of its execution shall be delivered into escrow with Escrow Agent during the Initial Escrow Period, subject nonetheless to Buyer's approval of form and content thereof unless delivery is waived in writing by the party intended as the recipient of such exhibit. Buyer's approval, in Buyer's sole and absolute discretion, of the form and substance of such exhibits shall be a condition precedent to Buyer's giving Buyer's Notice (if at all).

  • Incorporation of Exhibits, Annexes, and Schedules The Exhibits, Annexes, and Schedules identified in this Agreement are incorporated herein by reference and made a part hereof.

  • Incorporation of Schedules and Exhibits The schedules, attachments and exhibits referenced in and attached to this Agreement shall be deemed an integral part hereof to the same extent as if written in whole herein. In the event that any inconsistency or conflict exists between the provisions of this Agreement and any schedules, attachments or exhibits attached hereto, the provisions of this Agreement shall supersede the provisions of any such schedules, attachments or exhibits.
