Rejection of Entries; Notices of Rejected or Returned Entries. Any unexecuted Entry for which no notice of rejection is given shall be deemed canceled at the close of the fifth (5th) Business Day after the requested settlement date. We shall use reasonable efforts to notify you of our rejection of any Entry or return of any Entry from an ACH Operator; provided, however, that we shall have no liability if we fail to give any such notice. We shall not be liable to you for any delay or failure in executing an Entry unless such delay or failure is proximately caused by our gross negligence, and our liability therefore shall be limited to interest payable on the amount of such Entry from the requested settlement date until the earlier of (a) the date notice of rejection of such Entry is given by us, or (b) the close of the fifth (5th) Business Day following the settlement date.

  • Rejection of Entries Bank shall have the right to reject any Entry which does not comply with the requirements of Section 5 of this Article III and the requirements of Article VII ("Security Procedures"), or which contains an Effective Entry Date more than two (2) days after the Business Day such Entry is received by Bank. Bank shall have the right to reject an On-Us Entry for any reason for which an Entry may be returned under the Rules. Bank shall have the right to reject any Entry if Company has failed to comply with its account balance obligations as set forth in Section 11 below. Bank shall notify Company by phone or electronic transmission of such rejection no later than the Business Day such Entry would otherwise have been transmitted by Bank to the ACH Operator or, in the case of an On-Us Entry, its Effective Entry Date. Bank shall have no liability to Company by reason of the rejection of any such Entry or the fact that such notice is not given at an earlier time than that provided for herein.

  • Nonpayment and Procedures for Disconnection 12.1 If a Party is furnished Interconnection Services under the terms of this Agreement in more than one (1) state, Section 12.2 below through Section 12.19 below, inclusive, shall be applied separately for each such state.

  • Rejection of Bids 22.1. The ACCO may reject a Bid if:

  • Move-In Procedure The Resident must follow all move-in times, dates and procedures outlined by the Manager. The Resident will be notified of the date and time that the Resident may move into the Room. If the Resident wishes to move-in prior to the scheduled move-in day, the Resident may do so at the Manager’s then posted nightly rate and subject to availability (detailed in Table 1 & 3). Care is to be exercised in moving-in heavy objects to avoid damage to floor coverings, walls, doors and frames and any other part of the Residence. The Resident shall be responsible to pay forthwith to the Manager the cost of any damage to the Room or the Residence arising from the move-in.
