Common use of Release of Operation Performance Security Clause in Contracts

Release of Operation Performance Security. The Operation Performance Security shall remain in force and effect until the expiry of the entire Operation Period and until the Divestment Requirements is complied with in accordance with Article 33 (the “Operation Performance Security Period”) and shall be released pursuant to this Clause 9.2.3, provided the Concessionaire is not in breach of this Agreement and it has provided the Defects Liability Security in accordance with Clause 34.2. Upon request made by the Concessionaire for release of the Operation Performance Security and provided that the Concessionaire is in compliance with the requirements specified under this Clause 9.2.3, the Authority shall release the Operation Performance Security forthwith.
