In consideration of the payments to be made and the benefits to be received by the Executive pursuant to Article 3 of the CIC Agreement (the “Severance Benefits”) which the Executive acknowledges includes payments and benefits in addition to payments and benefits the Executive otherwise would be entitled to receive, the Executive, on behalf of himself/herself, his/her heirs, representatives, agents and assigns hereby COVENANTS AND AGREES NOT TO XXX OR OTHERWISE VOLUNTARILY PARTICIPATE IN ANY LAWSUIT AGAINST, AND FULLY RELEASES, INDEMNIFIES, HOLDS HARMLESS AND OTHERWISE FOREVER DISCHARGES
