Common use of RELEASES; DISCLAIMERS; ASSUMPTION OF RISK Clause in Contracts

RELEASES; DISCLAIMERS; ASSUMPTION OF RISK. In exchange for Rider being allowed to use Rise Services, Vehicles, and other equipment or related information provided by Rise, Rider agrees to fully release, indemnify, and hold harmless Rise and all of its owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, assigns, and to the fullest extent permitted by law any Municipality (including its elected and appointed officials, officers, employees, agents, contractors, and volunteers) in which Rider utilizes Rise Services, and every property owner or operator with whom Rise has contracted to operate Rise Services and all of such parties’ owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, and assigns (collectively, the “Released Persons”) from liability for all “Claims” arising out of or in any way related to Rider’s use of the Rise Services, Vehicles, or related equipment, including, but not limited to, those Claims based on Released Persons’ alleged negligence, breach of contract, and/or breach of express or implied warranty, except for Claims based on Released Persons’ gross negligence or willful misconduct. Such released are intended to be general and complete releases of all Claims.

In exchange for Rider being allowed to use Rise Ride Goat Services, Vehicles, and other equipment or related information provided by RiseRide Goat and / or its Owner Affiliates, Rider agrees to fully release, indemnify, and hold harmless Rise Ride Goat and all of its owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, assigns, and to the fullest extent permitted by law any Municipality (including its elected and appointed officials, officers, employees, agents, contractors, and volunteers) in with which Rider utilizes Rise the operators have contracted with to provide Ride Goat Services, and every property owner or operator with whom Rise has contracted to operate Rise sponsor of any of the Ride Goat Services and all of such parties’ the sponsor’s owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, and assigns (collectively, the “Released Persons”) from liability for all “Claims” arising out of or in any way related to Rider’s use of the Rise Ride Goat Services, Vehicles, or related equipment, including, but not limited to, those Claims based on Released Persons’ alleged negligence, breach of contract, and/or breach of express or implied warranty, except for Claims based on Released Persons’ gross negligence or willful misconduct. In exchange for Rider being allowed to use Rise Eride Club Services, Vehicles, and other equipment or related information provided by RiseEride Club or Supplier, Rider agrees to fully release, indemnify, and hold harmless Rise Eride Club and all of its owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, assigns, and to the fullest extent permitted by law any Municipality (including its elected and appointed officials, officers, employees, agents, contractors, and volunteers) in which Rider utilizes Rise Eride Club Services, and every property owner or operator with whom Rise Eride Club has contracted to operate Rise Eride Club Services and all of such parties’ owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, and assigns (collectively, the “Released Persons”) from liability for all “Claims” arising out of or in any way related to Rider’s use of the Rise Eride Club Services, Vehicles, or related equipment, including, but not limited to, those Claims based on Released Persons’ alleged negligence, breach of contract, and/or breach of express or implied warranty, except for Claims based on Released Persons’ gross negligence or willful misconduct. In exchange for Rider being allowed to use Rise Services, VehiclesElectric Kick Scooters, Bicycles, and other equipment or related information provided by RiseOperator, Rider Xxxxx agrees to fully release, indemnify, and hold harmless Rise Operator, Technology Services Provider and all of its and their owners, managers, affiliates, employees, contractors, fleet management service providers, officers, directors, shareholders, agents, representatives, successors, assigns, and to the fullest extent permitted by law any Municipality (including its elected and appointed officials, officers, employees, agents, contractors, and volunteers) in which Rider utilizes Rise Services, and every property owner or operator with whom Rise Operator has contracted to operate Rise Services and all of such parties’ owners, managers, affiliates, employees, contractors, officers, directors, shareholders, agents, representatives, successors, and assigns (collectively, the “Released Persons”) from liability for all “Claims” arising out of or in any way related to Rider’s use of the Rise Services, VehiclesElectric Kick Scooters, Bicycles, App, or related equipment, including, but not limited to, those Claims based on Released Persons’ alleged negligence, breach of contract, and/or breach of express or implied warranty, except for Claims based on Released Persons’ gross negligence or willful misconduct. Such released releases are intended to be general and complete releases of all Claims.
