Common use of Relocation or Expansion Clause in Contracts

Relocation or Expansion. The School's relocation or expansion to different facilities shall constitute a material change in the Contract and shall require prior written approval by the Commission. Approval shall be subject to the following conditions: (a) Prior written request to the Commission for approval of such relocation or expansion; (b) Submission to the Commission of a Certificate of Occupancy for the new facilities at least 30 days prior to the first day of occupancy; (c) Submission to the Commission of a lease, deed or other document showing the School possesses the right to occupy the new premises; (d) Documentation that the new facilities meet applicable health, safety, fire, building and zoning code requirements; and (e) Documentation that the new facilities are of sufficient size to safely house anticipated enrollment.
