Remainder Unchanged. Except as specifically modified and amended in this Second Amendment, the Agreement remains in full force and effect and binding upon the parties.
Remainder Unchanged. Except as specifically modified and amended in this Third Amendment, the Agreement remains in full force and effect and binding upon the parties.
Remainder Unchanged. The provisions of the Agreement unchanged by this Amendment shall remain in full force and effect.
Remainder Unchanged. Except as expressly amended by this First Amendment to Note, the Convertible Note shall be unchanged and shall remain in full force and effect and in accordance with its terms. In the event of any conflict between the terms of this First Amendment to Note and the terms of the Convertible Note, the terms of this First Amendment to Note shall govern.
Remainder Unchanged. All other terms of the Agreement which are not in conflict with the provisions of this Amendment shall remain unchanged in full force and effect. In case of a conflict in the terms of the Agreement and this Amendment, the provisions of this Amendment shall control.
Remainder Unchanged. Except as stated above, the terms and conditions of the Agreement are unchanged and remain in full force and effect.

This Amendment shall supersede and cancel all prior and contemporaneous written and oral agreements, correspondence and communications between the parties regarding the subject matter hereof. Except as provided in this Amendment No. 2, the 1440 Lease shall remain in full force and effect and unamended.
