Remedies of the Association. Section 5.01. Pursuant to Section 6.02 (l) of the General Conditions, the following additional events are specified: (a) a situation shall have arisen which shall make it improbable that the Program or a significant part thereof will be carried out; (i) Subject to subparagraph (ii) of this paragraph: (A) the right of the Borrower to withdraw the proceeds of any grant or loan made to the Borrower for the financing of the Project shall have been suspended, canceled or terminated in whole or in part, pursuant to the terms of the respective Other Financing Agreement providing therefor; or (B) any such loan shall have become due and payable prior to the agreed maturity thereof. (ii) Subparagraph (i) of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (B) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

Remedies of the Association. Section 5.01. (iib) Subparagraph Paragraph (ia) of this paragraph Section shall not apply if the Borrower establishes to the satisfaction of the Association that: (Ai) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (Bii) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement. Section 5.02. Pursuant to Section 7.01(h) of the General Conditions, the following additional event is specified, namely the event specified in paragraph (a) (ii) of Section 5.01 of this Agreement shall occur, subject to the proviso of paragraph (b) of that Section.

Pursuant to Section 6.02 (l) of the General Conditions, the following additional events are event is specified: (a) a situation shall have arisen which shall make it improbable that , namely: the Program or a significant part thereof will be carried outDFID Technical Assistance has not become effective by July 1, 2003; (i) Subject to subparagraph (ii) of this paragraph: : (A) the right of the Borrower to withdraw utilize the proceeds of DFID Technical Assistance or any grant or loan made to the Borrower for the financing of the Project shall have been suspended, canceled or terminated in whole or in part, pursuant to the terms of the respective Other Financing Agreement agreement providing therefor; or therefore, or (B) any such loan shall have become due and payable prior to the agreed maturity thereof. ; or (ii) Subparagraph (i) of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (B) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement. Section 5.02. Pursuant to Section 7.01 (h) of the General Conditions, the following additional event is specified, namely, that the event specified in paragraph (b) (i) (B) of Section 5.01 of this Agreement shall occur, subject to the proviso of paragraph (b) (ii) of that Section.

(ii) Subparagraph (i) of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: : (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and and (B) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

Remedies of the Association. Section 5.01. (ii) Subparagraph (i) of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: (A) such suspension, cancellation, cancellation or termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (B) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

Pursuant to Section 7.01 (h) of the General Conditions, the following additional event is specified, namely that the event specified in paragraph (b) (i) (B) of Section 5.01 of this Agreement shall occur, subject to the provisions of paragraph (b) (ii) of that Section.

(ii) Subparagraph (i) of this paragraph shall not apply if the Borrower Recipient establishes to the satisfaction of the Association that: : (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower Recipient to perform any of its obligations under such agreement; and (B) adequate funds for the Project Program are available to the Borrower Recipient from other sources on terms and conditions consistent with the obligations of the Borrower Recipient under this Agreement.

Remedies of the Association. Section 5.01. Pursuant to Section 6.02 (lh) of the General Conditions, the following additional events are specified: (a) a situation shall have has arisen which shall make it improbable that the Program Program, or a significant part thereof thereof, will be carried out; (i) Subject to subparagraph (ii) of this paragraph: (Ab) the right of KfW Grant Agreement or the Borrower to withdraw the proceeds of any grant or loan made to the Borrower for the financing of the Project XX Xxxxx Agreement shall have been suspendedfailed to become effective by March 31, canceled 1994, or terminated in whole or in partsuch later date as the Association may agree; provided, pursuant to however, that the terms of the respective Other Financing Agreement providing therefor; or (B) any such loan shall have become due and payable prior to the agreed maturity thereof. (ii) Subparagraph (i) provisions of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (B) that adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.; and (c) (i) subject to subparagraph (ii) of this paragraph: (A) the right of the Borrower to withdraw the proceeds of any loan or grant made to the Borrower for the financing of the Project shall have been suspended, cancelled or terminated in whole or in part, pursuant to the terms thereof, or (B) any such loan shall have become due and payable prior to the agreed maturity thereof; and

(b) Subject to paragraph (c) of this Section: (i) the right of the Borrower to withdraw the proceeds of the GOI Loan made to the Borrower for the financing of the Project shall have been suspended, cancelled or terminated in whole or in part, pursuant to the terms of the agreement providing therefor, or (ii) the GOI Loan shall have become due and payable prior to the agreed maturity thereof. (c) Paragraph (b) of this Section shall not apply if the Borrower establishes to the satisfaction of the Association that: (Ai) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreementAgreement; and (Bii) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

(iic) Subparagraph Paragraph (ib) of this paragraph Section shall not apply if the Borrower establishes to the satisfaction of the Association that: that (Ai) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (Bii) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

(i) Subject to subparagraph (ii) of this paragraph: (A) the right of the Borrower to withdraw the proceeds of any grant or loan made to the Borrower for the financing of the Project shall have been suspended, canceled or terminated in whole or in part, pursuant to the terms of the respective Other Financing Agreement agreement providing therefor; , or (B) any such loan shall have become due and payable prior to the agreed maturity thereof. (ii) Subparagraph (i) of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (B) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

Remedies of the Association. Section 5.01. Pursuant to Section 6.02 (lh) of the General Conditions, the following additional events are specified: (a) a situation shall have has arisen which shall make it improbable that the Program Program, or a significant part thereof thereof, will be carried out;; and (i) Subject to subparagraph (ii) of this paragraph: (A) the The right of the Borrower to withdraw the proceeds of any loan or grant or loan made to the Borrower for the financing of the Project shall have been suspended, canceled cancelled or terminated in whole or in part, pursuant to the terms of the respective Other Financing Agreement agreement providing therefor; or (B) any such loan shall have become due and payable prior to the agreed maturity thereof. (ii) Subparagraph (i) of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (B) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

Remedies of the Association. Section 5.01. Pursuant to Section 6.02 (lh) of the General Conditions, the following additional events are specified: (a) a situation shall have has arisen which shall make it improbable that the Program EAP, or a significant part thereof thereof, will be carried out;; and (i) Subject subject to subparagraph (ii) of this paragraph: (A) the right of the Borrower to withdraw the proceeds of any loan or grant or loan made to the Borrower for the financing of the Project shall have been suspended, canceled cancelled or terminated in whole or in part, pursuant to the terms of the respective Other Financing Agreement agreement providing therefor; , or (B) any such loan shall have become due and payable prior to the agreed maturity thereof.; and (ii) Subparagraph subparagraph (i) of this paragraph shall not apply if the Borrower establishes to the satisfaction of the Association that: (A) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (B) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement.

Remedies of the Association. Section 5.01. Pursuant to Section 6.02 (lh) of the General Conditions, the following additional events are specified: (a) a situation shall have arisen which shall make it improbable that the Program or a significant part thereof will be carried out; (ib) Subject to subparagraph paragraph (iic) of this paragraphSection: (Ai) the right of the Borrower to withdraw the proceeds of any loan or grant or loan made to the Borrower for the financing of the Project shall have been suspended, canceled cancelled or terminated in whole or in part, pursuant to the terms of the respective Other Financing Agreement agreement providing therefor; or (Bii) any such loan shall have become due and payable prior to the agreed maturity thereof. (iic) Subparagraph Paragraph (ib) of this paragraph Section shall not apply if the Borrower establishes to the satisfaction of the Association that: (Ai) such suspension, cancellation, termination or prematuring is not caused by the failure of the Borrower to perform any of its obligations under such agreement; and (Bii) adequate funds for the Project are available to the Borrower from other sources on terms and conditions consistent with the obligations of the Borrower under this Agreement. Section 5.02. Pursuant to Section 7.01 (d) of the General Conditions, the following additional event is specified, namely that the event specified in Section 5.01 (b) (ii) of this Agreement shall occur, subject to the proviso of Section 5.01 (c) of this Agreement.
