Common use of Removal and Disposal of Structures and Obstructions Clause in Contracts

Removal and Disposal of Structures and Obstructions. The Contractor shall remove any existing structure or part of a structure which is to be replaced or rendered useless by new construction. Salvage material derived therefrom shall become the property of the Contractor and shall be disposed of by him except as otherwise provided in the Specifications or the Plans. Payment for this Work will be made under the pay items identified for such Work in the Proposal. The removal and disposal of structures and obstructions shown on the Plans to be removed and not covered by a separate pay item in the Proposal shall be performed by the Contractor at his own expense and shall be included in other items of Work Removal that is not shown on the Plans or in the Specifications as included in other items of Work which, in the opinion of the Engineer, requires special equipment will be paid for at a price negotiated prior to the removal, as specified in Subsection 103.05, titled “Modifications.”
