Common use of RENT AT THE DATE OF FORFEITURE OR DISCLAIMER Clause in Contracts

RENT AT THE DATE OF FORFEITURE OR DISCLAIMER. If at the date of the forfeiture or disclaimer there is a rent review pending under this lease, then the initial annual rent to be reserved by the new lease shall be the greater of: (a) the Annual Rent previously payable (or which would have been payable but for any abatement or suspension of the Annual Rent or restriction on the right to collect it) under the lease prior to forfeiture or disclaimer; and (b) the open market rent of the Property at the relevant Review Date, as determined by the Landlord before the grant of the new lease.
