Repaid Amounts. Notwithstanding Article 4,if at any time, pursuant to court order or applicable law, payment of any amounts arising from or on account of the obligation to provide standard offer service are annulled, set aside, invalidated, declared to be fraudulent or preferential, rescinded or must otherwise be returned, refunded or repaid by Beneficiary upon the insolvency, bankruptcy or reorganization of [Standard Offer Provider] or otherwise, then the Guarantor shall be liable for the amounts so repaid to the same extent as if such amounts were never received by the Beneficiary.

Repaid Amounts. The Loan amounts repaid pursuant to articles 8.2 and/or 8.3 of this Agreement may not be used again. In case of partial mandatory and voluntary prepayment, they will be deducted from the principal instalments still to be repaid, from all the instalments in question and in proportion.
Repaid Amounts. If any amount is repaid to the Warrantors by Buyer Parent, Buyer, the Company or any of its Subsidiaries pursuant to this Article XIII, an amount equal to the amount so repaid shall be deemed never to have been paid by Warrantors for the purposes of calculating Warrantors’ total aggregate liability under Section 9.1.

  • Unpaid Amounts For the purpose of determining an Unpaid Amount in respect of the relevant Transaction, and to the extent permitted by applicable law, interest will accrue on the amount of any payment obligation or the amount equal to the fair market value of any obligation required to be settled by delivery included in such determination in the same currency as that amount, for the period from (and including) the date the relevant obligation was (or would have been but for Section 2(a)(iii) or 5(d)) required to have been performed to (but excluding) the relevant Early Termination Date, at the Applicable Close-out Rate.
