REPAIRS AND RESTORATION. (a) Whenever Comcast or any of its agents, including any contractor or subcontractor, takes up or disturbs any pavement, sidewalk or other improvement of any public or private property, the same shall be replaced and the surface restored in as reasonably good condition as before the disturbance within twenty (20) business days of the completion of the disturbance, weather permitting. Upon failure of Comcast to comply within the time specified and the Township having notified Comcast in writing of the restoration and repairs required, the Township may cause proper restoration and repairs to be made and the expense of such work shall be paid by Comcast upon demand by the Township. (b) Whenever Comcast or any agent, including any contractor or subcontractor, shall install, operate or maintain equipment, cable, or wires, it shall avoid damage and injury to property, including structures, improvements and trees in and along the routes authorized by the Township if required for the proper installation, operation and maintenance of such equipment, cable, or wires. Comcast shall promptly repair and restore any public or property that is damaged as a result of construction, installation, repair or maintenance of the Cable System within twenty (20) business days, weather permitting. (c) Comcast’s operation, construction, repair and maintenance personnel, including all contractors and subcontractors, shall be trained in the use of all equipment and the safe operation of vehicles. Such personnel shall follow all safety procedures required by all applicable federal, state and local laws and regulations. All areas of the Cable System shall be inspected in accordance with such applicable federal, state and local laws and regulations so as to prevent hazardous conditions or risks to safety for the public and/or operating and maintenance personnel. Comcast shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township or any public utility serving the Township. (d) Should a public safety emergency occur as a result of, incident to, or connected with operation, construction, repair, or maintenance activities by Comcast personnel, including all contractors and subcontractors, then such personnel shall immediately contact the applicable public safety emergency dispatcher (e.g. 9-1-1). (e) Whenever Comcast or any agent, including any contractor or subcontractor, shall disturb any pavement, sidewalk or other public property in order to perform any underground activity, it shall utilize the Pennsylvania One Call System prior to any such disturbance. Comcast shall adhere to any additional undergrounding requirements which the Commonwealth may establish in the future. Comcast shall adhere to all requirements of the Pennsylvania Underground Utility Line Protection Act. (f) All structures and all lines, equipment and connections in, over, under, and upon streets, sidewalks, alleys, and public and private ways and places of the Township, wherever situated or located, shall at all times be kept and maintained in a safe and suitable condition and in good order and repair in accordance with customary industry standards and practices.

(d) Should a public safety emergency occur as a result of, incident to, or connected with operation, construction, repair, or maintenance activities by Comcast personnel, including all contractors and subcontractors, then such personnel shall immediately contact the applicable public safety emergency dispatcher (e.g. 9-1-1). (e) Whenever Comcast or any agent, including any contractor or subcontractor, shall disturb any pavement, sidewalk or other public property in order to perform any applicable underground activity, it shall utilize the Pennsylvania One Call System call 811 prior to any such disturbance. Comcast shall adhere to any additional undergrounding requirements which the Commonwealth State may establish in the future. Comcast shall adhere to all requirements of the Pennsylvania Maryland Underground Utility Line Protection ActFacilities Damage Prevention Law, Title 12 of the Maryland Public Utilities Code, as amended. (f) All structures and all lines, equipment and connections in, over, under, and upon streets, sidewalks, alleys, and public and private ways and places of the TownshipCounty, wherever situated or located, shall at all times be kept and maintained in a safe and suitable condition and in good order and repair in accordance with customary industry standards and practicesrepair.

Upon failure of Comcast If Charter fails to comply within repair, replace or otherwise correct a Public Right-of-Way following (10) days’ written notice by the time specified and the Township having notified Comcast in writing of the restoration and repairs requiredTown, the Township Town may cause proper complete any repair, replacement, restoration or other correction and repairs to be made and invoice Charter for the expense documented, reasonable cost of such work shall repair, replacement, restoration or other correction and be paid by Comcast upon demand by reimbursed for the Townshipsame. (c) ComcastCharter’s operation, construction, repair and maintenance personnel, including all contractors and subcontractors, shall be trained in the use of all equipment and the safe operation of vehicles. Such Charter’s operation, construction, repair and maintenance personnel shall follow all safety procedures required by all applicable federal, state and generally applicable local laws and regulations, including the NESC. All areas of the Cable System shall be inspected in accordance with such applicable federal, state and local laws and regulations so as to prevent hazardous conditions or risks to safety for the public and/or operating and maintenance personnel. Comcast Charter shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township Town or any public utility serving the TownshipTown. (d) Should a public safety emergency occur as a result of, incident to, or connected with operation, construction, repair, or maintenance activities by Comcast personnel, including all contractors and subcontractors, then such personnel shall immediately contact the applicable public safety emergency dispatcher (e.g. 9-1-1). (e) Whenever Comcast Charter or any agent, including any contractor or subcontractor, shall disturb any pavement, sidewalk or other public property in order to perform any underground activity, it shall utilize the Pennsylvania New York One Call System (xxx.xxxxxxxxxxxxxxxx.xxx) prior to any such disturbance. Comcast Charter shall adhere to any additional undergrounding requirements which the Commonwealth State of New York may establish in the future. Comcast Charter shall adhere to all requirements of the Pennsylvania 16 NYCRR Part 753, Protection of Underground Utility Line Protection ActFacilities. (fe) All structures and all lines, equipment and connections in, over, under, and upon streets, sidewalks, alleys, and public and private ways and places of the TownshipPublic Rights-of-Way, wherever situated or located, shall at all times be kept and maintained in a safe and suitable condition and in good order and repair in accordance with customary industry standards and practices.

Comcast shall promptly repair and restore any public or private property that is damaged as a result of construction, installation, repair or maintenance of the Cable System within twenty ten (2010) business days, days -- weather permitting. Comcast shall ensure adherence to all construction codes currently or hereafter in effect. (c) Comcast’s operation, construction, repair and maintenance personnel, including all contractors and subcontractors, shall be thoroughly trained in the use of all equipment and the safe operation of vehicles. Such Comcast’s operation, construction, repair and maintenance personnel shall follow all safety procedures required by all applicable federal, state and local laws and regulations. All areas of the Cable System shall be inspected regularly in accordance with such applicable federal, state and local laws and regulations so as to prevent hazardous conditions or risks to safety for the public and/or operating and maintenance personnel. Comcast shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township or any public utility serving the Township. (d) Should a public safety emergency occur as a result of, incident to, or connected with operation, construction, repair, or maintenance activities by Comcast personnel, including all contractors and subcontractors, then such personnel shall immediately contact the applicable public safety emergency dispatcher (e.g. e.g., the emergency phone number for the North American Numbering Plan (NANP) 9-1-1). (e) Whenever Comcast or any agent, including any contractor or subcontractor, shall disturb any pavement, sidewalk or other public property in order to perform any underground activity, it shall utilize the Pennsylvania One Call System prior to any such disturbance. Comcast It shall notify the Pennsylvania One Call System and adhere to any additional undergrounding requirements which the Commonwealth may establish in the future. Comcast shall adhere to all requirements of the Pennsylvania Underground Utility Line Protection Act. (f) All structures and all lines, equipment and connections in, over, under, and upon streets, sidewalks, alleys, and public and private ways and places of the Township, wherever situated or located, shall at all times be kept and maintained in a safe and suitable condition and in good order and repair in accordance with customary industry the safety standards of the applicable federal, state and practiceslocal laws. (g) Comcast shall notify property owners adjacent to the Public Rights-of- Way of impending construction that requires a permit in the manner required by the general provisions of the Township Code.

(b) Whenever Comcast or any agent, including any contractor or subcontractor, shall install, operate or maintain equipment, cable, or wires, it shall avoid damage and injury to property, including structures, improvements and trees in and along the routes authorized by the Township County if required for the proper installation, operation and maintenance of such equipment, cable, or wires. Comcast shall promptly repair and restore any public or private property that is damaged as a result of construction, installation, repair or maintenance of the Cable System to as reasonably good condition as before the disturbance within twenty fifteen (2015) business daysdays from the completion of the work causing such damage, weather permitting. Comcast shall perform all replacement and restoration pursuant to the generally applicable codified standards of the County. (c) Comcast’s operation, construction, repair and maintenance personnel, including all contractors and subcontractors, shall be trained in the use of all equipment and the safe operation of vehicles. Such personnel shall follow all safety procedures required by all applicable federal, state and local laws and regulations. All areas of the Cable System shall be inspected in accordance with such applicable federal, state and local laws and regulations so as to prevent hazardous conditions or risks to safety for the public and/or operating and maintenance personnel. Comcast shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township County or any public utility serving the TownshipCounty. (g) To the extent practicable, above-ground equipment placed on private property, other than Drops and drop related equipment, shall be placed at the location and in the manner requested by the property owner. A Franchisee shall provide affected homeowners with at least ten days' advance written notice of its plans to install new equipment, covered under this subsection, and shall make reasonable efforts to confer with such homeowners before any work is done. Franchisee shall not install new equipment, covered under this subsection, on private property without the written consent of the property owner(s).

Upon failure of Comcast Service Electric to comply within the time specified and the Township having notified Comcast Service Electric in writing of the restoration and repairs required, the Township may cause proper restoration and repairs to be made and the expense of such work shall be paid by Comcast Service Electric upon demand by the Township. The Township may apply Section 8.2 in the event of a violation of this Section. (b) Whenever Comcast Service Electric or any agent, including any contractor or subcontractor, shall install, operate or maintain equipment, cable, or wires, it shall avoid damage and injury to property, including structures, improvements and trees in and along the routes authorized by the Township if required for the proper installation, operation and maintenance of such equipment, cable, or wires. Comcast Service Electric shall promptly repair and restore any public or private property that is damaged as a result of construction, installation, repair or maintenance of the Cable System within twenty ten (2010) business days, weather permitting. (c) ComcastService Electric’s operation, construction, repair and maintenance personnel, including all contractors agents, contractors, and subcontractors, shall be trained in the use of all equipment and the safe operation of vehicles. Such personnel shall follow all safety procedures required by all applicable federal, state and local laws and regulations. All areas of the Cable System shall be routinely inspected in accordance with such applicable federal, state and local laws and regulations so as to prevent hazardous conditions or risks to safety for the public and/or operating and maintenance personnel. Comcast Service Electric shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township or any public utility serving the Township. (d) Should a public safety emergency occur as a result of, incident to, or connected with operation, construction, repair, or maintenance activities by Comcast Service Electric personnel, including all contractors and subcontractors, then such personnel shall immediately contact the applicable public safety emergency dispatcher (e.g. 9-1-1). (e) Whenever Comcast Service Electric or any agent, including any contractor or subcontractor, shall disturb any pavement, sidewalk or other public property in order to perform any underground activity, it shall utilize the Pennsylvania One Call System prior to any such disturbance. Comcast Service Electric shall adhere to any additional undergrounding requirements which the Commonwealth may establish in the future. In addition; in areas with underground installation, when Mediacom lays temporary cable on the ground (whether for repair or new service), Mediacom shall complete such installation and surface repair within the aforementioned time period — weather permitting. Upon failure of Comcast Mediacom to comply within the time specified and the Township Town having notified Comcast Mediacom in writing of the restoration and repairs required, the Township Town may cause proper restoration and repairs to be made and the expense of such work shall be paid by Comcast Mediacom upon demand by the TownshipTown along with any liquidated damages applied by the Town in accordance with Section 9 "Franchise Violations, Damages and Revocation." (b) Whenever Comcast Mediacom or any agent, including any contractor or subcontractor, shall install, operate or maintain equipment, cable, or wires, it shall avoid damage and injury to property, including structures, improvements and trees in and along the routes authorized by the Township Town if required for the proper installation, operation and maintenance of such equipment, cable, or wires. Comcast Mediacom shall promptly repair and restore any public or private property that is damaged as a result of construction, installation, repair or maintenance of the Cable System within twenty ten (2010) business days, weather permitting. (c) ComcastMediacom’s operationoperating, construction, repair and maintenance personnel, including all contractors agents and subcontractors, shall be thoroughly trained in the use of all equipment and the safe operation of vehicles. Such Mediacom's operation, construction, repair and maintenance personnel shall follow all safety procedures required by all applicable federal, state and local laws and regulations. , All areas of the Cable System shall be inspected in accordance with such applicable federal, state and local laws and regulations so as to prevent hazardous conditions or risks to safety for the public and/or operating and maintenance personnel. Comcast , Mediacom shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township Town or any public utility serving the TownshipTown. (d) Should a public safety emergency occur as a result of, incident to, or connected with operation, construction, repair, or maintenance activities by Comcast Mediacom personnel, including all contractors agents and subcontractors, then such personnel shall immediately contact the applicable public safety emergency dispatcher (e.g. 9-1-1)., (e) Whenever Comcast Mediacom or any agent, including any contractor or subcontractor, shall disturb any pavement, sidewalk or other public property in order to perform any underground activity, it shall utilize the Pennsylvania Delaware One Call System "Miss Utility" prior to any such disturbance. Comcast Mediacom also shall adhere to any additional undergrounding requirements which the Commonwealth State and/or Town may establish in the future. Comcast Mediacom shall also adhere to all requirements of the Pennsylvania Delaware Underground Utility Line Protection ActAct 26 Xxx, X, §000. (f) All structures and all lines, equipment and connections in, over, under, and upon streets, sidewalks, alleys, and public and private ways and places of the TownshipTown, wherever situated or located, shall at all times be kept and maintained in a safe safe, non-hazardous and suitable condition and in good order and repair in accordance with customary industry standards and practices.

REPAIRS AND RESTORATION. (a) Whenever Comcast Time Warner Cable or any of its agentsagent, including any contractor or subcontractor, takes up or disturbs any pavement, sidewalk or other improvement of any public or private propertyway or place, the same shall be replaced and the surface restored in as reasonably good condition as before the disturbance within twenty (20) business days of the completion of the disturbance, weather permitting. Upon failure of Comcast Time Warner Cable to comply within the time specified and the Township having notified Comcast Time Warner Cable in writing of the restoration and repairs required, the Township may cause proper restoration and repairs to be made and the expense of such work shall be paid by Comcast Time Warner Cable upon demand by the Township. (c) ComcastTime Warner Cable’s operationoperating, construction, repair and maintenance personnel, including all contractors agents and subcontractors, shall be thoroughly trained in the use of all equipment and the safe operation of vehicles. Such Time Warner Cable’s operating, construction, repair and maintenance personnel shall follow all safety procedures required by all applicable federal, state and local laws and regulations. All areas of the Cable System shall be routinely inspected in accordance with such applicable federal, state and local laws and regulations maintained so as to prevent hazardous that conditions or risks to that could develop into safety hazards for the public and/or operating and maintenance personnelpersonnel may be corrected before they become a hazard. Comcast Time Warner Cable shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township or any public utility serving the Township. (b) Whenever Comcast Franchisee or any agent, including any contractor or subcontractor, shall install, operate or maintain equipment, cable, or wires, it shall avoid damage and injury to property, including structures, improvements and trees in and along the routes authorized by the Township, except as may be approved by the Township if required for the proper installation, operation and maintenance of such equipment, cable, or wires. Comcast Franchisee shall promptly repair and restore any public or private property that is damaged as a result of construction, installation, repair or maintenance of the Cable System within twenty ten (2010) business days, weather permitting. (c) ComcastFranchisee’s operationoperating, construction, repair and maintenance personnel, including all contractors agents and subcontractors, shall be trained in the use of all equipment and the safe operation of vehicles. Such Franchisee’s operating, construction, repair and maintenance personnel shall follow all safety procedures required by all applicable federal, state and local laws and regulations. All areas of the Cable System shall be routinely inspected in accordance with such applicable federal, state and local laws and regulations maintained so as to prevent hazardous that conditions or risks to that could develop into safety hazards for the public and/or operating and maintenance personnelpersonnel may be corrected before they become a hazard. Comcast Franchisee shall install and maintain its wires, cables, fixtures, and other equipment in such a manner as shall not interfere with any installations of the Township or any public utility serving the Township. Comcast It shall notify the Pennsylvania One Call System no less than three (3) and no more than ten (10) working days in advance of any such disturbance and adhere to any additional undergrounding requirements which the Commonwealth may establish in the future. Comcast Franchisee shall also adhere to all requirements of the Pennsylvania Underground Utility Line Protection Act. (fe) All structures and all lines, equipment and connections in, over, under, and upon streets, sidewalks, alleys, and public and private ways and places of the Township, wherever situated or located, shall at all times be kept and maintained in a safe and suitable condition and in good order and repair repair. Franchisee shall not keep or maintain disconnected or loose cables, lines, or wires on utility poles or anywhere else in accordance with customary industry standards the public rights-of-way. (f) Franchisee shall notify property owners adjacent to the Public Rights-of- Way of impending construction that requires a permit in the manner required by the general provisions of the Township Ordinances and practicesRegulations, including this Agreement.
