Common use of Repairs completed by Municipality Clause in Contracts

Repairs completed by Municipality. Where: (a) the Company fails to complete a temporary repair to the satisfaction of the Municipality within seventy-two (72) hours of being notified in writing by the Municipality, or such other period as may be agreed to by the Parties; or (b) the Company and the Municipality agree that the Municipality should perform the repair, then the Municipality may effect such work necessary to perform the repair and the Company shall pay the Municipality’s reasonable and verifiable direct costs of performing the repair.
