Report of Improper Access, Use, or Disclosure. Business Associate shall report to the County any access, use, or disclosure of the PHI not permitted by this Agreement, including but not limited to security incidents of which the Business Associate becomes aware.

Report of Improper Access, Use, or Disclosure. Business Associate agrees to report to Covered Entity any use or disclosure of the Protected Health Information not provided by this Agreement. Business Associate shall report to Covered Entity in writing of any access, use or disclosure of Protected Health Information not permitted by the Contract and Addendum, and any Breach of Unsecured PHI of which it becomes aware without reasonable delay and in no case later than 10 calendar days after discovery (42 USC Section 17921; 45 CFR Section 164.504(e)(2(ii)(C); 45 CFR Section 164.308(b)).

  • Prohibition on Unauthorized Use or Disclosure The Business Associate will neither use nor disclose the Covered Entity’s Protected Health Information, except as permitted or required by this Addendum or in writing by the Covered Entity or as Required by Law. This Agreement does not authorize the Business Associate to use or disclose the Covered Entity’s Protected Health Information in a manner that will violate Subpart E of 45 CFR Part 164 if done by the Covered Entity.
