Common use of Representative of Operator Clause in Contracts

Representative of Operator. Operator shall appoint, subject to Owner’s prior approval, a properly qualified individual to act as the representative of Operator (the “Operator’s Representative”). Operator’s Representative shall advise Owner on issues regarding the operation and maintenance of the Facility. Operator’s Representative is authorized and empowered to act for and on behalf of Operator on all matters concerning this Agreement and its obligations hereunder, other than any amendments to or waivers under this Agreement. In all such matters, Operator shall be bound by the written communications, directions, requests, and decisions given or made by Operator’s Representative (or its designee) within the scope of its responsibilities.

Operator shall notify Owner of the identity of Operator’s Representative and any individual appointed in replacement thereof. Operator’s Representative shall advise Owner on issues regarding the operation and maintenance of the Facility. Operator’s Representative is authorized and empowered to act for and on behalf of Operator on all matters concerning this Agreement and its obligations hereunder, other than any amendments to or waivers under this Agreement. Operator’s Representative is authorized and empowered to act for and on behalf of Operator on all matters concerning this Agreement and its obligations hereunder, other than any amendments to or waivers under this Agreement.
