Request to Disclose. Where a request is made for permission to disclose confidential information hereunder, a reply thereto will be made within two Business Days after receipt of such request, failing which the Party requesting will be entitled to disclose such information in the limited circumstances specified in such request as if such consent had been given.
Request to Disclose. Where a request is made for permission under this Article 8 to disclose Confidential Information, a reply thereto shall be made as soon as possible and in any event within two (2) Business Days after receipt of such request, failing which the Party requesting will be entitled to disclose such Confidential Information in the limited circumstances specified in such request as if such consent had been given.

In the event that the Recipient or anyone to whom the Confidential information has been supplied by the Recipient receives a request to disclose under the terms of a subpoena, order, civil investigative demand or similar process issued by a court of competent jurisdiction or by a governmental body all or any part of the Confidential Information, such Recipient shall: notify Bulgargaz promptly in writing of the existence, terms, and circumstances surrounding such request, and consult with Bulgargaz on the advisability of taking legally available steps to resist or narrow such request, and give Bulgargaz the opportunity to defend, limit or protect against such disclosure, and if disclosure of such information is lawfully required, furnish only that portion of the Confidential Information which is legally necessary, or, if disclosure is required for all circumstances, to require from the competent authority that the provided information is processed by observing the confidentiality regime between the Parties. Any public announcement relating to the existence of this Agreement and/or discussions between the Parties shall be agreed in advance between Bulgargaz and the Recipient in writing.

(1) Where a request is made for permission to disclose confidential information hereunder otherwise than for the purposes described in Section 13.1(2) and Section 13.1(3), a reply thereto will be made within three (3) Business Days after receipt of such request, failing which the Party requesting will be entitled to disclose such information in the limited circumstances specified in such request as if such consent had been given.

If the Recipient receives a request to disclose any of the Owners’ Confidential Information under the terms of a valid order of any court, competent jurisdiction or government body, the Recipient shall (1) where legally permissible, promptly notify the Owner in writing prior to making any such disclosure of the existence, terms and circumstances surrounding such a request in order to facilitate Owner seeking a protective order or other appropriate remedy from the proper authority and cooperate with Owner in seeking such an order or other remedy(2) take such steps, in consultation with Owner, as are necessary to resist or narrow such request and (3) if Owner is not successful in precluding the requesting legal body from requiring the disclosure of the Confidential Information and disclosure is necessary, Recipient will furnish only that portion of the Confidential Information which is legally required. Furthermore, the Recipient agrees to exercise all reasonable efforts to obtain an order or other reliable assurances that confidential treatment will be afforded to any such portion of the disclosed Confidential Information which the Owner so designates.

Where a request is made for permission to disclose confidential information hereunder, Wave Uranium shall reply thereto within three (3) Business Days after receipt of such request, failing which Wave Uranium shall be deemed to have consented to such disclosure in the limited circumstances specified in such request.

Where a request is made for permission under this Article 7 to disclose confidential information or issue a press release or other public statement, a reply thereto will be made as soon as possible and in any event within two Business Days after receipt of such request, failing which the Party requesting will be entitled to disclose such information in the limited circumstances specified in such request as if such consent had been given.
