Common use of Required Permits Clause in Contracts

Required Permits. As of the expiration of the Diligence Period, City Bodies shall: (i) have determined that Developer shall have: (A) obtained; or (B) determined that Developer shall be able to obtain; all Required Permits; and (ii) the Survey is acceptable to the City; and (iii) there are no exceptions or matters of record reflected in the Commitment or Survey which would have a materially adverse effect on the Project or the City Bodies’ ability to perform hereunder or under any Ancillary Agreements.
